The immigration law that requires that aliens be documented for legal entry. Those who sneak intto the country are referred to as "entry without inspection" (EWI). Others enter with legal documentation and then violate the terms on which they have been admitted by taking jobs that are not authorized or overstaying the authorized period of stay in the country. Both types of illegal immigrants are deportable under Immigration and Nationality Act Section 237 (a)(1)(B) which says:
"Any alien who is present in the United States in violation of this Act or any other law of the United States is deportable."

This is comical actually. State laws regarding who can make arrests when and for what varies, and I'm not sure what federal law says on it (immigration violations are federal violations, not state). I know in Texas a person has to be committing a felony. That's #1. Since unlawful presence is not a felony, that would not be a situation where a citizen could make an arrest I don't think. And a person can not assume the immigrant entered illegally because some people overstay visas. Besides, even if we assumed everyone entered illegally, a federal felony, we can't go arresting people for felonies that are not in progress. Off-duty police officers almost never mess with that, so why should citizens? Here's the other issue. There is no requirement for any illegal alien, or any person for that matter, to identify themselves to another person in situations where someone is looking to make a citizen's arrest. In fact, in many cases a police officer cannot walk up to someone and demand identification. Furthermore, local and state police cannot enforce immigration laws. So how can a private citizen verify someone is illegal in order to arrest them? Lastly, making citizen's arrests can be filled with liability. If someone fights the arrest, and then you use excessive force, your over. YOU go to jail. Some may fight because they don't know who you are. If someone comes to me trying to make a citizen's arrest for no good reason, they will have a serious problem. People don't understand liability, and the role it plays, when they go and attempt to detain someone. If you screw it up, just a little bit, you can be charged with a felony.

While our laws allow for a citizen to "arrest" someone, it is very limited in what can be done, and puts the arrestee in some danger of legal retribution. You cannot detain anyone you believe breaking the law, as that is a form of illegal detention in itself. You alos cannot keep the person you arrest from just plain leaving the scene. If you wish, in this case, to turn someone in as an illegal immigrant, contact the FBI or the local immigration office and report this person. Don't get carried away by videos of Dog the Bounty Hunter and take this into your own hands. It will only backfire against you if you detain, or even so much as lay hands on an individual. Let government representatives handle this.
I commend your willingness to get involved and do what you believe to be the right thing, but be careful!!!

When you make a citizen's arrest you can't cuff anyone. You can only restrain people legally if they are trying to harm themselves or others. If you cuff him, YOU could got to jail or be sued. And yes, illegal aliens can sue you just like anyone else. Illegal aliens are covered by the constitution and have the same rights to trial etc. as anyone else. They can own guns. They have the right to freedom of speech, press, and religion.
You can call police. But I doubt that they would do anything. I am dating a cop and he has murderous crack heads to deal with. They don't have time for illegals.
Contact the department of immigration!
Also report their employer if any.
Sadly, our government sucks, and seems to make only more loopholes to protect illegal immigrants.

YOU will be the one arrested if you do this. YOU can NOT detain someone, as a citizen arrest, unless that person has committed a FELONY. Even then, YOU can still get in some major legal issues.

Making a citizens arrest could be a very dangerous thing to do. If you feel so strongly about this person, then I would contact INS and report the person as an illegal. Then, I would leave the persons fate up to them.

It is my belief that a citizen's arrest is legal only for felony acts. Before carrying out this action, I would call immigration to determine if INS will investigate the matter.

I dont suggest transporting, that could be considered kidnapping or unlawful imprisonment. Do some extensive research of state and federal laws before making this arrest, you might also want to contact the local authorities beforehand in order to have them on alert so that you get a quick response.
