What is the sentence after being convicted? I do not know.Iam not asking for statistics on convictions of other crimes. Solely for being an illegal alien. It is illegal but not a crime to want to make a living. The terrorists that drove the planes into the WTC thats a crime.

The regulations are that they are deported to their country of origin. If they are tried and sentenced for a crime it is for something other than just being in the USA without valid immigration documents. My hunch is that the answer to your question is zero.

Illegal immigration's a crime, maybe only a civil offense, but it's still a crime. Unfortunately, it's not the last law that gets broken by illegal aliens in many cases, and 20 years of negligence have established an undesirable precedent for illegal immigration into our country, and correcting for 2 decades of missed opportunities is going to be a herculean, but not impossible task. It'll get done, though, and the border fence will be built, too. Have faith in that!

If I could give Blue Steel and Lace more than one thumbs up, I would. This really is the problem with immigration (illegal and legal) that no one addresses. I am an immigrant (legal) myself but the money I earn gets spent in America (except for flowers on my mum's birthday - there is a florist in the Scottish borders who does such a lovely job).

One day, this issue will bite all of us in the backside, including the business owners who make more money than they deserve supporting this "venture." One day, sooner than we think, we will be producing no goods to sell (because so much is now made abroad) and we will have less and less money circulating in the economy. It's a double whammy. The extremism of both Republicans (allowing big business to benefit from this cozy arrangement) and Democrats (who seem to be happy to let all and sundry come here without requiring any permanent attachment to this country) is going to cost this country and when it does it will be too late to correct it.

The punishment for violation of 8 USC 1325 (entry w/o inspection) is 6 months confinement and a fine of $5,000 or both. Personally I know that lots of illegal aliens get sent to magistrate court and are charged violation of 8 USC 1325 and all are convicted. They usually get time served no fine and a Special Assessment fee of $10.

Before the implementation of the Expedited Removal program, these illegal aliens would get a voluntary return even they were processed for formal deportation. This was due to the lack of bed space at detention facilities for immigration violators.

Now when an illegal alien gets charged with violating and convicted of 8 USC 1325, they are processed as an Expedited Removal. This is a formal removal from the country with a 5-year ban on re-entry.

This 5-year ban means that they cannot return to the US for 5 years, legally or illegally. After the 5 years they can re-apply for permission to enter the US legally, but most of these illegal aliens just assume they can return illegally. Wrong, if caught and there is no evidence that they made a re-application for admission into the US (legally) then the original order of removal is reinstated and they are deported to their country, again.

This is where most of these illegal aliens who have been convicted of 8 USC 1325 start getting into real trouble with the law. After being formally deported from the US when they return illegally, they are charged with violation of 8 USC 1326 (re-entry after removal). The punishment for violation of this crime is 2 years confinement and a fine of $250,000. It takes time but the more a convicted illegal alien return and get caught after being formally deported, the worse it get for them. Who has time to waste in jail, I don't. Illegal aliens bring misery to themselves.

I'm not sure if those statistics are available.But I'm sure there are some.Most are deported back to their home country.Its a misdemeanor crime,it may not be on the scale of murder but its still a crime.Its also a felony to aid and abet an illegal alien.

A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he:

* assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or

* encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or

* knowingly assists illegal aliens due to personal convictions.

Penalties upon conviction include criminal fines, imprisonment, and forfeiture of vehicles and real property used to commit the crime. Anyone employing or contracting with an illegal alien without verifying his or her work authorization status is guilty.Aliens and employers violating immigration laws are subject to arrest, detention, and seizure of their vehicles or property. In addition, individuals or entities who engage in racketeering enterprises that commit (or conspire to commit) immigration-related felonies are subject to private civil suits for treble damages and injunctive relief.

It's both illegal and a crime to steal education funds from our children, health care funds from our sick and social services from our poor. If they are here illegally, using our schools and other services for themselves or their family is doing just that. We limit poor immigrants because they make too little money to pay their way through taxes, and we have to make up the difference. We have to stretch our funds in schools and our facilities to cover their children, at the expense of degraded education for our own.

On your question, I have heard of many, many cases where people were arrested for coming back after being deported or after dodging a warrant for deportation. That is a felony.

However, people don't want them in jail, just where they can't ruin our schools. A few hundred thousand we overlooked, a few million we gave amnesty to, only to find that many of those amnestied then became 'bases' for family and friends coming illegally.

How do we deal with that problem if we give amnesty to screened illegals, again?

They get deported. If they are held at all, it's only long enough for them to be processed before deportation.
And it is a crime.
Someone has already quoted the statutes, so I won't get into all that. Plus most of the "living" they are making gets sent back to their country via Western Union so they aren't even helping our economy by earning a living here.
It would be like me sneaking into your kitchen, using your food & utensils to cook a meal, and then feeding myself & other people with it, while I leave your kitchen full of dirty dishes.

they broke the law, by coming here. that makes them criminals. no its not a crime to want to make a living, why didnt they do that in their own country? it is a crime to steal social security card numbers so you can get on welfare.90% of these people are not hard working people looking to make a living, they are looking for something for free.where is it the taxpayers of this country, to feed and support all these freeloaders? i think they should all be piocked up, and took back where they belong. illegal is illegal, and i dont feel sorry for any of them, they knew they were breaking the law, when they came here.

Your phrase "it is illegal but not a crime" doesn't make any sense at all. Perhaps this is the problem with illegal immigrants. They know what they are doing is illegal but they can't figure out that illegal = crime.

Zero serves time for being illegal aliens. They are deported when caught. Unfortunately not enough of them are caught once they get beyond the border and the Border Patrol check points.
