My son is hoping to attend a 2 year college next fall (2007),he will be on probation. Can the probation dept. keep him from going to school.
It is in the same state different city, about 2-3 hours from where we live. He has already been accepted. He has a felony, received at age 18- is a changed person now 20 and ready to do something with his life.

In order to transfer within the state, your son's current probation officer and the judge both have to agree to allow your son to transfer. If either says no, your son cannot move.

Since your son has been admitted to the college already, he has that in his favor. Has he been following all the conditions of his probation since he was placed on probation? If he has never been revoked, his chances of transfer are greater.

In addition, even if the sending county approves the move, the receiving county has the option to turn down his transfer.

Your son needs to be a salesman. He needs to sell the idea of why allowing him to transfer is for the good of the communities, both the current community and the new community. He can explain how this will improve the chances that he will be a better person, and how his degree will help others.

I have a felony as well (for marijauna) and was on probation. I had to transfer my probation to go to the University of Oregon.

The Decision rests soly on the P.O. . It will be more difficult if the crime is a sex offense.

It will also be more difficult if the school is out of state.

If your son has no violations, it is pretty likly he will be aproved, espescaily since school or work is part of his probation requirments.

Make sure your son stays on good terms with his PO!

The probation officer has to talk to him, it would require a letter being sent from his current probation office to the one in the place he plans to live in , and it is totally up to the other city whether they are willing to accept him. Even if his current PO is fine with the move, if the other county says "No", then he cannot transfer.
This is how things are done where I live, you will get a more helpful answer by just talking to your son's current PO.

My brother got his transferred but the judge did at his sentencing. He should talk to his probation officer and find out how to do it. They may have to have a judge approve it now. Good Luck!

He needs to get in touch with the courts right away incase there is a ton of paperwork to do to get there....Good luck to him.
