about how long after someone makes a report will cps come out to a home. do us like a parent have any rights. what if the acusations are false.

Like the other poster said, it usually depends on the severity of the complaint made, but in a lot of cases, they usually come out within a few days to a week. They sometimes call first and alert you they are coming. That too depend on the investigator and the severity if the complaint made.

Yes, as a parent you do have rights, but cps will trample over those rights if you are not familiar with them and they think that you are not familair with them, which most people are not. My first piece of advice to you is to google fightcps.com and go on the "What to do if cps is investigating you" link. This site came in very handy for me when I was in that same predicament.

Google A.F.R.A.I.D, fightcps.org and lifevsliberty.org, all those sites can give you helpful info on dealing wiht cps sucessfully. I wish you the best of luck.

I don't know if all states are different or pretty much the same, but from what I've heard:

They would probably get in touch with you fairly soon after the complaint (and depending on whether they even took the complaint seriously).

You have rights as parents, but, from what I hear, you almost don't have rights when it comes to whether they investigate you or not. They may send one worker to first "get a reading" on how legitimate they complaint may have been, and if that worker isn't sure enough that all if fine, they may investigate further. If they were to find something and start to make issues about you would definitely need an attorney. I am not under the impression you have much in terms of rights to refuse an investigation, but you do have rights as a parent and rights if CPS tries to tell you what you should be doing with your child(ren).

From what I've heard, they can find out accusations are false; but you would still have a record on file for a certain amount of time anyway.

If the accusations are false you may not be able to sue the state agency because of immunity they have (although there is the chance that if they disregard your Constitutional rights they may lose that immunity because they did not act in a way that a state agency in the U.S. should act). You may want to talk with an attorney about suing whoever lied to CPS for libel.

From what I've heard it is not a matter of someone showing up, finding out the accusations were fault, and saying, "Oops - sorry. We'll leave now." Once they get involved it is a whole big process even if they end up saying all is fine with your family.

CPS as well as DCFS are ruthless judgmental people on the same plain as the IRS---I HATE THEM ALL...

The miserable people show up at your home or your child's school with in 30days----if it's a serious allegation they'll be to your childs school with in 72 hours---and then to your home for the face to face fact gathering within 5 days----They have 30-60 days to gather all the facts pertaining to the reported situation and will make a conclusion to the accused in writing---

Most of the time the allegations are unfounded----but if they are you'll have a battle for your rights---like I said they're right up there with the IRS!!!!!

They will usually do some investigating first before they actually come out. They will on the other hand want to hear your side of the story. I am assuming you are talking about Childrens Protective Services! Just be aware if the accusations are bad the police will also then become involved.

depends on the severity of the situation and the staffing/funding in your area. YES you have rights...however if the findings are bad your rights are a whooooole lot less.

if the accusations are false then you have nothing to worry about!
