I was coming home from a wedding and was pulled over for speeding. My license was suspended but I was only driving because the other passenger had been drinking. What will a judge do when I show up in court?

No....I don't think the judge will feel sorry for you.....because I sure don't. If you're driving while knowingly suspended, and are stupid enough to speed, then you deserve the book thrown at you. The only possible reason for driving while suspended and speeding would be to drive someone to the hospital in an obvious emergency. In that case, the officer would probably have escorted you there. Driving an intoxicated friend home is certainly not an emergency.

nope you cant drive on a suspended license. You will more than likely be convicted with driving while license suspended. As far as your drunk friend, The judge will probably say that you could have called a friend or a taxi.

It's possible that if the trip was too far for a normal taxi ride, he may show leniency, but don't count on it.

My question is that if you actually did this, why on earth would you be speeding if you knew your license was suspended????

Maybe you deserve to have the suspension lengthened, especially if it was originally done for breaking traffic laws.

C'mon dude, pull your head out and start acting like a responsible adult.

Depending on why your licence was suspended I can tell you from experience that I got busted for driving on a suspeded here in sunny california and got ten days in jail and no you will not talk your way out of this one when you go in front of a judge. BTW if I get busted again for driving while suspended I'm looking at 30 days in jail.

Obviously the answer is legally No, and getting a Taxi for both of you was the best answer. Get a lawyer, you may be able to get off with a warning; but don't hold your breath. Your legal grounds are pretty slim; and of course the judge is going to ask you if you were drinking at this wedding too.

I'm not sure what state your in but in most states the law is pretty clear cut and most judges are going to find you guilty. While I'm thankfull you didn't let the drunk passenger drive most judges are going to tell you to call a cab next time.

probably give you a fine about $100.00 bucks or so and 12 points for driving on a suspended license unless you can get ppj probation before judgment then probably a fine and a couple days community service but no points at least this is what happened to me

No licence, no driving.

Tell the judge the truth, and he'll (very unlikely) let you off, but most likely not. The actual judgement will either be a fine less than 500, or a complete revocation of your licence.
