The father of my child filed for child support on himself in his homestate, and I have been ordered to appear in court in his homestate. I want to receive back child support for my son. If i can't make the court date, will the back child support be dismissed, and will he still be ordered to pay regular child support?

Call the courthouse where the hearing is set. You should be able to appear by phone. If you don't show--anything can happen.

CALL the Courthouse, EXPLAIN that YOU CAN NOT AFFORD to be there in that State on the Court Date, and can you PLEASE HAVE the Judge CALL you instead -- because most of the time this is acceptable -- and the JUDGE should understand how far away you are from the hearing site and be willing to accept your testimony via the phone.

BACK Child Support (as long as the documents have been filed and they are clearly in arrears) will NOT be dismissed UNTIL The father pays back the amount he OWES that he never paid in the first place.

It relies upon on how the choose brushed off the case. the two brushed off "with prejudice" or "with out prejudice." If the case replaced into brushed off with prejudice, he can not refile the petition returned ever.

if he missed you shouldn't because it more then likely will go in your favore. my bf missed his one time and they gave his ex what she wanted and he had to go back to patition it. so good luck.
