I live in a basement suite and the landlord does not live upstiars. Instead there are 3 people who all smoke. THe landlord has told them twice to not smoke inside, but they insist on smoking inside. They think that smoking in the bathroom we can not smell it. It is just not about smell. SMoke causes my asthma to get worse and i have had to have medication to deal with this issue. Moving out is not an option. Any suggestions? Should i keep a list of everytime i smell smoke and tell my landlord again? They also smoke marijauna, should i call the police when i smell it? I need help. it is hard to deal with punks like these. Thanks for any tips.

Okay, well i forgot to mention that i have talked to the people upstiars about this issue before and they do smoke outside and in their bathroom. However, thisis an old house and the smell and second hand smoke still comes down during certain times of the day.

Secondly, the landlord has specificly told us and them there is to be NO smoking inside the house. SO it is NOT their right to be smoking cigerettes or marijauna inside. I dont care taht they smoke, i just do not want to have my health go downhill from second hand smoke.

Thirdly, I live with two other girls that hate the smoke as well.

I will take the air filter thing into account, but wouldnt it be proper if the people upstiars bought one as well? or atleast footed the bill if they are going to keep smoking inside?

Thank you all for your advice, but further advice would help me even more. It is not like i dont like these people. it is not like i am asking them to quit or anything.

if you get sick because of their smoking and your home was agreed upon in a lease agreement to be non smoking then you are in the right and you need to make that aware to your landlord. Tell him you are getting progressively sicker and wheezier because of their smoking and you think that you might end up with an ashtma attack and mabye that will spin his *** into action. Your landlord is being lazy and he should be evicting those tenants because it is endangering your health to be around smoke. Tell your landlord they are also smoking dope and that is illigal and you dont feel comfertable in your own home because the drug smell is giving you a headache or some crap. Lay into your landlord its his job to take care of these people. Yes not only should you write it down when you smell smoke be a royal pain in the *** and ask them not to smoke in there by knocking on their door and telling them you can barely breath and could they kindly stop smoking before you have an asthma attack. Then write it down and call your landlord and let him know everytime you have had to go up there to ask them to stop.

If your place of rent was listed as non smoking and he has an agreement with them not to smoke and its part of a lease then you have every right to make it stop.

If the landlord has asked them not to smoke inside, and they are continuing to do so, the landlord certainly needs to be aware that they are continuing to smoke. If the landlord truly doesn't want them to smoke inside, there should be something in the lease, and their smoking inside could actually be a violation of their lease agreement, giving the landlord further control of the situation. If not currently in the lease, and the landlord doesn't want to allow smoking, the landlord should put this in future lease agreements.

As far as the marijuana issue, you should definitely call the police regarding this issue. You might give a head's up to the landlord first.

O.k. first of all, nobody considers marijauna some sort of horrible drug problem. So seriously no need to call the D.E.A. they would probably not care as long as they are just smoking it and not selling it. However; you do have a medical condition that they are disrespecting. I think that you should write them a letter to start with. Tell them that you do not appreciate it and about your asthma. Additionally, somehow drop in that that you know they smoke pot and that bugs you. Chances are that might make them scared of you- knowing that you know about their little habit. Secondly, what about asking them to use a fan to blow it out the window...or I've had friends that use their kitchen vent hoods to smoke under. That would greatly reduce the smoke. If all else fail, tell your landlord that your lease and rights are being violated and that HE/SHE needs to do something to fix it before you have to take legal action. That might light a fire under him to actually do something. Good luck, and remember-- nobody responds well to requests that come with anger to insult.

If your health is truly at risk and the landlord has not been willing or able to stop them from smoking, then you may have to make moving a possibility for your own well-being.

You have risks with complaining to the neighbors or asking for sympathy by explaining your health issue to them, these make you the potential target of their irresponsible acting out. This could make things very difficult if not dangerous for you.

If you repeatedly complain to the Landlord, you risk making yourself the problem. It might become easier for him to ask you to leave or to raise your rent prohibitively to encourage you to leave, if you become the "problem".

I suggest that you investigate the local laws, and ordinances, and the terms of their lease. Be fully informed about your legal options. Investigate the options for moving, find something that IS more acceptable than recurring asthmatic attacks and potential hospitalization and or death that could come from living with inconsiderate smokers.

Once you have all the info and are prepared to move, approach your landlord and make arrangements to either get them to leave, or for yourself to terminate your lease and move. Be business-like and professional, but be sure to let your landlord know that you need to move due to the smoking habits of your neighbors making it unsafe for your health condition. It may be very helpful to consult books on tenant laws that apply to your region. It may also add strength to your position to get a letter from your doctor supporting your claim.

MOVE.

Those people will NOT change..I've dealt with rude neighbors before---and they are all the same--they never change. There must a place in hell where rude neighbors come from.

You can call the police on them, and see if the Landlord will kick them out--but he probably wont.

Look for another place. A home should be a place of Peace.

i do understand your problem but it seems to me that you are out numbered by the smokers.
somebody else pointed out that they were paying rent and was entitled to smoke.
This is very true unless it was a specified by the landlord that smoking wasn't allowed.
going to the landlord every time you smell smoke is not going to do any-one any good.
is there any way that you could discuss this matter with your neighbors in order to reach an agreement?
if not, i am afraid you will just have to cope with it.

Talk to your neighbors about the way you feel, try to figure out a solution, a middle ground. Maybe you can propose something like a "smoking garden" or something like that. A dialog can always solve a problem, it is better than being rude. Tell them about your Asthma.

the weed part... if you don't mind them coming bak at you, you can call the police. However, have you talked to them about the smoking? why don't you talk to them and agree on certain times when they can smoke. like.. give them a schedule or sumthing.
if not, call the landlord n complain!

if you r good, u may talk to them about ur asthma and your medications and ask for their sympathy.

I smoke too but if i go to someones home and they don't then i go outside, your lanlord should just kick them out. Tell him about them smoking weed, maybe he might do something.

I got one of those Oreck air filter machines. It's great! If you've got asthma, you ought to have one anyway.

I do wonder how they're getting the smoke to go down to the basement. When I smoke, it rises.
