plain and simple, this is the issue.
I want to marry my girlfriend who has been here as an Au pair for a year, her J-1 Visa expired on the 24th of October, she would leave the country on the 23 of November. We both want to get married and she wants to stay here and start life with me. I just got discharged from the military, starting a Federal job here pretty soon. so the question is, will the fact that her Visa expired give us a hard time for legal issues, or it doesnt matter once we are married her status changes. And I'm her sponsor to this country and INS cant say she's an illegal immigrant. without sending me to an immigration officer, what would be the outcome to this marriage due to the short time period we have left. Thank you

Do not leave the country!!
Once she leaves the country, she will need a waiver for the overstay. Instead, you two need to get married and file the paperwork to adjust her status. This all needs to be done within 180 of the visa expiration. Talk to an attorney, leaving the country is a bad idea.
