Do not walk the tracks themselves, but the property they go through. We do it all the time and the game warden has never said anything -we are checked by the warden almost every year.

It doesn't matter who is right or wrong about the railroad permit, the bottom line is this and this alone. Good Hunter ethics says to ALWAYS ask permission before hunting on anyone elses property, and that includes the railroad. DON'T assume anything based on answers from this site, go ask the railroad who owns the property you wish to hunt. I think CSX owns (don't quote me) about 2 acres or more to either side of the tracks and it is federally regulated, the RR that is.

The railroad is private property protected by Federal and State law. Trespassing is illegal and they will NOT grant hunting passage on the RoW - they don't want the liability of people on their property. The railroad is a dangerous place, so stay away.

Addendum: Whoever gave me thumbs down needs to familiarize themselves with the law, and stop playing by the tracks. Its not smart - I've seen people after they've gotten hit by trains, and its not pretty...

Ask the railroad for hunting permission,often they;ll sell right of way permits for hunting and fishing.

That land is owned by the RR, you need there permission to hunt on it.

You should be able too, but you run in to the problem of birds flyin on farmers land that is where you'll run into them bitching about empty shotgun shell casings and trespassing
