Please would someone translate this into easy to understand language, it is relating to the financial seperation of a divorce. many thanks.

I'm asking this for a friend of mine, basically he still lives in the matrimonial home, she left, the mortgage is in her name only as she wanted it that way as he suffers from high blood pressure, he used to pay his wages into her bank, so on paper it looks as if he has payed nothing towards anything, she cleared the savings account when she left again only in her name and claims there is only 5k in it when there was alot more she has pensions etc wants him to sell the house as she is now living with and expecting baby by another man. He has now had this piece of paper thru from the courts asking for the above.

The court really wants to have the whole history of the marriage set out in bite size pieces so that it can be easily assimilated and dealt with point by point. Your friend seems quite able to tackle this, having given you the various points already which you have in turn been able to set down in writing. The issues between him and the other party are
(1)that he denies her claim to sole ownership of the house;
(2)he wishes to recover the money represented by his wages which was paid into her bank account over the years and which has disappeared without trace;
(3)he wishes to put her to proof as to the assets which she is holding on resulting trust for him which are represented by the assets paid into her account in this way;
(4)he wishes to preserve his beneficial rights under her pension plans. (She presumably named him as her beneficiary).

For the chronology, start with the date and place of the marriage, then move on to the purchase of the house, the time when it was agreed that his wages would be paid into her bank account and then just work systematically through to the time she left and embezzled (or squirrelled away) the joint savings. A few little explanatory details (e.g. his blood pressure) would help.

He shouldn’t be doing this on his own. Mistakes at this stage could be very costly.

Chronology is a time line and issues are what $$ would be in dispute (assets and debts).
So list in order by date - all outstanding debts AND then . . .
all assets acquired during the marriage that both may want possession of ( real estate, vehicles, stocks, bonds, antiques, art, jewelry etc )
Note: As most divisions are 50 / 50, I would dispute any responsibility for debts arising out of concealed breaches of trust, such as gambling or drug debts incurred by the other person.
Mortgage note: The house is an asset regardless of title unless acquired prior to the marriage. Whom paid the monthly note is irrelevant in a marriage, this is NOT a friend / roomate situation. The house will be sold and the proceeds divided after paying off the remaining amount on the note. (unless he decides to buy out her interest in the property)

When did the separation begin and what are the things causing it and the legal divorce? Infidelity? Disagreement? Incompatibilty?
