My partner is in jail for a minor offence. I recently went to check up on his car as he told me that the parking permit will run out on the 4th Nov. When I found his car he had 2 parking tickets. Do I or his mother (since car is registered to her address but his name) have to pay the fines before it adds up or can I seccessfully appeal against this on his behalf? I cannot get a new parking permit to put in the car as the carkeys are held at his prison and they refuse to let him send them to me.
Any help would be great. Thank is advance

He was only supposed to go to court. No one expected for him to be sent to prison stright after. He has been in there for 2 months now and he only managed to make phone calls two weeks ago. reason car is registered at his mum is because he is renting a room which will not be his perment address.

He's responsible for the current fines, and any further fines that the car gets if it's not moved.
You have no right to appeal them at all as he, or someone else, should have moved the car before he was locked up.

He parked the car there with the permit almost run out knowing that he had an impending court case which could result in a custodial sentence. The registered keeper is responsible for paying the tickets and any clamping or impounding fees. As he is the registered keeper and as he was the person responsible for parking it in a position which it was likely to be ticketed, (once his permit had run out) he should pay. If he had parked the car there, why did he have the keys on him when he went to court?
Maybe you should pay the tickets, or they will be registered as an unpaid debt and eventually a warrant will be issued for non payment, in which case he could find himself back in jail.
Also why is the car registered at his mother's address? Does he live there, if not he is commiting another offence of wrongly registering the vehicle.
With jails full to capacity, it's highly unlikely he was given a custodial sentence for a minor offence if he's a first time offender, so either it's not so minor, or he's a serial criminal.
To be honest, it sounds like your partner needs a wake up call and this is probably it.

Firstly I would try appealing. Even if the appeal is not successful its worth a go and doesnt cost anymore than the price of a stamp. If you dont pay the tickets the car will eventually be taken by bailiffs anyway and his mum will have the hassle of them calling at her house. The only thing that confuses me is that if the car is parked illegally and you cant have the keys - he is just gonna continually get parking tickets until you move it - you need to get them car keys and quick xx

Why should you be able to appeal? His car is illegally parked. He doesn't have a valid permit. It's his fault he is in jail and too cheap to have a second set of keys made. Pay the tickets and have him reimburse you when he gets out. Everybody wants free rides and doesn't want to take the blame for their own actions and then they blame it on the judicial system. Sounds like his problem to me.

Minor Offense ?? So he is serving a misdemeanor ?? How long does he have to serve ? 30-60 days ??
You or his mother should be able to notify who issued the citations and inform them that your partner is currently in jail. (Tell them which jail so they are able to verify) and that he is going to be a little late on paying the fines. See if they will be able to hold off on the citation until he is released. More than likely they will hold off on any additional proceedings against him as they want the money more than him doing more time for Failure to pay/Failure to Appear.
Has his Mother attempted to retrieve his property ?? The jail staff should have no problems with handing over his property to his Family member. She will have to go to that jail and request the keys. He may have to verify that she is allowed to retrieve the vehicle keys but that will be the best way to get the vehicle keys. Otherwise someone is going to have to pay for a Tow Truck to come and pick-up the vehicle and get it moved.

im not 100% sure about american law but in the UK if a person gets a ticket in somone else's car..its the registerd car owners responisibity to pay for the ticket..but if your in jail you can proove you wasnt the driver so you will be able to produce documents to say it wasnt you..the only problem here is that the person who was driving is now resposible for the ticket and..they may enquire if the car was insured the other driver to use the car..hope this helps

I would say no you don't have to pay this Parking fine as 1 it is not your car and 2 it is not His Mothers car either if I were you I would appeal this ticket as you will defiantly not have to pay it

There is no reason that you should not attempt an appeal, with official paperwork from the nick to prove that he was unable to move the vehicle, you are in with a shout

Contact his lawyer he/she should be able to get the keys. Pay the ticket and get remibursement from him.

Let him do it from jail. That is a reasonable excuse for not paying. Let it get impounded.
