Comming home tried to turn right didn't see car comming thought it was safe to go, got struck cops showed up driver immigrant 6 years in country no driver license driving car not listed as an operator, I was not cited but officer summoned her to court , didn't arrest her due to not see her driving the vehicle, My question formally is since i was at fault should i be surcharged even though she doesn't have a license or insurance?? or should I be found 50/50 I feel i should be cleared cause technically she had no business being on the road, without a license..

It wouldnt hurt to consult with a lawyer, I feel certain that you will not be at fault even though you failed the right of way when you thought it was safe to move, but the other driver did not have a operator's license, so she had no business on the road, In cases like that, she will be at fault. A court summons is another form of being arrested, you stated you were not cited, but she was summoned to appear in court. so that makes it pretty clear that she was charged with the accident. Did you get a accident report from the police? You are rightfully entitled to one, also notify your insurance immediately if you have not done so already. Give them a heads up of what happended so that the other driver cannot try to file a claim against you. You may have done us another favor, usually, cases like this involving a immigrant, they will check to see if she is in this country legally, if not, she will be deported. A big thank you if that turns up to be the case.

You did not have right of way. That is simply the point in regards to the accident. They will probably be fined for operating with a liscene as well as no insurance.

You're actions are your own. If you pulled out infront of a liscenced and insured person should you get off? What someone else does has no bearing on the fact that you didn't see and got struck.

Sorry, but your negligence is the cause of the accident 100%. The other person's license status did not cause you to pull out when it was not safe to go. You can and should be surcharged. The license issue is not a defense to liability. Also, the police giving a ticket is not what constitutes liability.

The fact that the other driver had no license or insurance has nothing to do with it. You caused the accident!!

You are guilty of the accident and have to pay the consequences. She is only guilty of driving without license, nothing to do with you.

its your fault you have to pay..however she is in big troblue she has to pay a big fine because she was driving whit not a license so becarefull next time and good luck.
