Currently there are no federal tax laws that support responsible single parents who do not have full custody of their childeren. Which ever parent has them the most out of the year can claim all of them. I don't see how this can be fair. If child support is paid, the parent paying it pays the income taxes on it and it is included in their income. The parent recieving the support does not show it as income nor do they have to pay taxes on it. I dont understand why responsible single parents who are in their kids lives and are supporting them financially can not utilize a deduction at all. So I guess my question is... What is the route a person has to take in order to change the current tax laws to show some equality and recognition for those of us showing responsibility with their parental duties?

Talk to your congressman, and write to other members of congress, pointing out what you feel is inequitable about the current law. They're the ones who can change it.

You can always negotiate with the other parent for the right to claim the child or a child. Of course this is better to do prior to final divorce but the IRS doesn't care who claims as long as it is only one parent.

If no change in law from Congress, then a decision from the U.S. Tax Court in Washington, D.C. would be where you would file suit against the IRS. You can also ask the IRS for a Private Letter Ruling on your personal situation and although not tax law can be used for your benefit and others also. See more about private letter ruling at IRS.gov. The IRS actually has a very good website.

Good Luck

support the Fair Tax act - HR 25 and S 25

gets rid of the IRS - and savings tax, capital gains,
inheritance, FICA, SocialSecurity tax, medicare tax
- - A total of 10 taxes
replaces with a consumption tax paid at the register

the have invested $2 million in reasearch to see if a Flat Tax,
a VAT (value added tax), or consumption tax wuld be the best.

in addition, you would get a prebate of taxes paid for the poverty level of $9,800 per adult - each month you would get $185
for children it would be $65 - e.g. a family of four making $26,600 would get just over 500.month as a prebate + no deductions from your check (except insurances)

check them out - endorsed by 80 leading economists and several
univerisities like Harvard, Duke, Texas
