her husband took off over 12 years ago. im going back over in dec to see her and we would like to get married. any ideas? I would like to bring her here but divorce is not allowed in the philippines. any help would be nice.

Maybe she can get an annulment of marriage instead? She should consult a lawyer as it might be a bit trickier than a straightforward divorce. In Catholic countries, I've heard that the Catholic church has to grant the annulment or something. Best of luck!

Are you sure divorce is not legal in the Philippines? I would check that out.

If she cannot divorce there, she could come to the states and file for a divorce on grounds of abandonment. Twelve years of no contact would be sufficient, I'm sure.

Seek legal counsel to make sure I'm right on that issue. If I am, then bring her over and deal with the divorce thing here.

There are a few ways out, if you are serious about marrying and you want it to be legal.

According to Philippine law, there is ONE provision for ending a marriage after it had begun, and this is called 'Article 36'. In the Family Code, this article provide for the termination of a marriage if either one of the married people is determined by a psychiatrist to be psychologically incapable of performing any one of the marriage obligations. This has even grown into a cottage industry of sorts.

What this means to you, is that if you have enough money, you can visit an appropriately willing psychologist, have him declare your girlfriend 'unfit', and then give that determination to a lawyer and have the marriage nullified. It will cost you, but it is one of the very few legal options.

The other would be to have the husband declared legally dead. You say he took off twelve years ago... has anyone seen him since? In most countries you only have to be completely out of touch for about five years to be declared legally dead. So unless the husband is still around and easy to find, you can have your girlfriend made a widow instead of a crazy person.

Or you can just wait. Some politicians in the Philippines try to introduce new laws to allow divorce from time to time. One may even pass eventually. You never know.

Her marriage in the Philippines probably wouldn't hold much water here in the states. I say bring her back and marry her!

I wonder if it is illegal to marry her here in the US.? Even though she is considered married over there. It is my understanding that once a couple splits up in the Philippines and both parties agree that they no longer wish to be married then there is NO marriage. Maybe she is not considered married any longer.? I'd check into it. Good luck to the both of you and have a blessed day!

Apply for a financee visa, bring her to the USA and marry her here. When you apply for the wedding license have her check never married as her status. It is a lie but they cannot check. If the husband does not contest it here in the USA nothing will ever happen.

It would be in her best interest to convert to a Muslim allowing her to get divorced in the Philippines and then convert back to whatever she was.

My cousin had to hire a private investigator to find his ex and get a divorce to marry his curret wife. It took about 3 months.

she can apply for one. me and my ex after 22 years got one. he went the cheap way. did it his self. all i had to do was sign. tell her to look into a no contest divorce. it only cost him $390.00. that was 5 years ago. good luck.
