In most states, they don't allow children to ride without belts or carseats (or booster seats).

In CA, children must be restrained with a seat belt or with a child safety seat if they are too small for belts. It's the law here in CA. Don't know about your state.
If a child is riding in a car without a seat belt or restrained, the driver can be pulled over and ticketed.

I do believe that if the driver were caught with a child sans seat belt, they would receive a ticket.

I concur with above answers. In the U S of A all states require seat belt and child seats for children. If they don't Feds cut highway maintenance out. Same with adults. If you really hate wearing a belt, move to GA. and drive a pickup ! Don't invite me to your funeral though !
