ok, i have this 16 year old living here with me, she was on the streets and i felt bad for her, so i took her in, i called and spoke to her father and he didnt seem to mind that i took her in, i have taken in other kids in the past, the problem is, is that i want this kid to get an education and this kid wants to too, but the mother wont sign papers so she can go to school, should i sue for custody and do you think i can get custody?

First, you should be given a pat on the back for caring so much for a child that is not related. The first step I would have taken was contacing the parents, and if there was no rapid action(s) taken, then...

You should talk with an Attorney regarding emancipation laws.

Once you open a can of worms with CPS and other agencies...they may take this girl for an unpleasant ride (foster homes, court hearings, etc.). You may never gain 100% full custody of this teen unless she is immediate family, even 50% custody requires many court hearings...by then she will be of legal age and miss out on the rest of her education.
She has two short years to obtain free education. Beleive in Jesus...PRAY that He lights the way for all of you! HE has a plan...I beleive this is the reason for this journey...

i think its a wonderful thing that you are doing and you should be commended for it. there arent many selfless people like you out there.
yeah i think you should give it ago you may not get custody as such but you can become her legal guardian if you can satisfy the court that her parents dont care which by the sounds of things shouldnt be too hard.

also the child is 16 so she is of an age where the courts will take into account anything which she says. (i.e she wants to live with you and why.)

If you are not related to the girl, you will NOT get custody unless the mother and father sign her over to you. There is one exception to this. . . and that is IF social services or CPS gets involved in the case and forces removal of parental rights in court. That is not likely. The father should be able to sign the papers to get her in school and to allow you to take care of her medical needs, but the mother can fight this if she wants. You can talk to your attorney but I think you will not win.

How long before she turns 17? In alot of states, they are considered of legal age when they turn 17. Check with Social Services regarding this. As far as adopting her, you should consult an attorney, as he can tell you if you can get her without the mothers permission, and just using the father's. If the mother has totally blew her off and neglected her, then you shouldn't have too much trouble getting her.

At 16 she can have herself declared emancipated, you can still steer her in all the right directions and gjver her the love and support she will need, but she will be a very self reliant adult if given the chance to show she can be responsible. I find it very admirable that you have taken on this responsibllity, you are a very giving person to give up part of yourself and are willing to share love and time..good luck

CPS will just make things ickier because of the red tape and bureacracy involved. They may even remove from your home. Get her emancipated from her parents or try to get guardianship through the father. I am curious as to the mother won't sign. Is it pride?

I think you should go over to your local CPS (Child Protective Services) and file a complaint of negligence against the parents and proclaim them as unfit parents. They will get fined because it is a federal mandate that all children get a free education.

yes sue for custody and save her dear life! she will appreciate you later for it. You can get mom on neglect from refusing to sign papers for school to let her go or maybe help the girl get her adult rights from the court.

I really don't think her mother will give up custody. I suggest you move on.
