He has worked at my shop for 2 years now and has signed a lease aggreement that states he is responsible for his own taxes, his only obligation to me is to pay his weekly chair rent. He has in own key to the shop and comes and goes when he pleases I do not boss him or any of my barbers around by any means, there on there own.

Am I in any danger of paying any of his taxes even though he is a independent contractor?

Do you pay him, or does he just collect the barber fees directly from his clients? If you don't pay him, then he's not even an independent contractor to you, he's just a guy who rents a chair at your place. What he does with his income is none of your business, though he can't be too bring sharing with you that he hasn't paid any taxes.

Why isnt he asking the other people who rent in this same shop? The shop must be liscensed, the barbers must maintain thier barbers liscense current. If he was told this, the others too were cited or know what he needs to do. If he is the only barber in this shop for some reason or other, have him visit another barber shop and find out what the deal is. Again, everyone in the shop will be doing the same thing. If he was cited he must do what has been deemed legal. He can also call a local beauty/barber college and ask their assistance.

i would suggest to you that you check the wording in your lease and get an attorney to look at it..
i have been a barber for 43 years,,, it is my policy that my people are totally self employed... i have no controll over how they they pay their federal or state tax... but with the local tax , they have to bring in their registration for all local tax...
i also make them license their chair as a shop in a shop... this is something i have pushed for a long time in our state . it did become law this year...
now the other thing is on your liabilty insurance you want to make sure that they are listed on your policy.....

an independent contractor is not coverd under you libality ins. you need to check with your ins agent and get this covered.
i did this ,,, what i had to do is to list a maxium number of barbers ,,,, not names ,,, just number that would be working there....

in the last 3-5 years lawsuits against barber shops and owners have sky rocketed ,,for every reason,,, but the number one reason is that a barbering was drinking or doing drugs on the job. and a customer was nicked with the clippers,, or shears...

i am the president of our barber association here, and we track these lawsuits. and from what we know about is that from 2000-dec 2005, there have been 158 lawsuits filed against barber shops... every case was won by the customers... the average settlement was $6000.00
barbers had better wake up and smell the coffee,,, barbers are a rare breed of people and most are hard headed,,
business practice has changed a lot,, we need to be professional in everything that we do ,,, and that includes paying your taxes,,, just think what will happen when you apply for social security, and you draw a very small amount,, because you did not pay it in ..

i also started in 2000 of requireing all my barbers to take a drug test before they start and i pay for that... i want good people , no drinking ,, and drug free.

AS an independent contractor, he works for HIM, not for you. HE is responsible for paying his taxes.

no the responsibilty is all his and it can't come back on you even if you employed him as a regular employee. the most they could make you do is attach his wages (if he were regular employee). But seeings as he'll be going to jail sometime you might want to keep a few replacements handy

You aint liable for his taxes - grass the bastard up cos he akes taxes higher for everyone else by not paying

no, as long as you give him a 1099 then its up to him to pay his own taxes
