does he have the car? do you have the car? If you have the car, sue him for the balance. Do you have the title? do not give it up until the car is paid for. good luck

My advice is similar to anothers:

If he took possesion of the vehicle when he agreed to the $500 price, and paid $366 toward that purchase. Then the purchase was made, the verbal contract was consumated and he ows you the rest of the balance.

If you still have posession of the vehicle and you were going to give him the car when he paid the rest of the money, then the transaction has yet to take place in full, and you need to give him his money back.

If the purchase was not completed then he can pull out at any time.

Similar situation would be me going into Wal-mart, filling my cart full of stuff, and having the cashier ring it all up. Up until the moment I finish paying for the merchandise I can still say..."Nah, forget it" and walk out the door.

They can't arrest me for stealing because I don't have THEIR merchandise. It didn't become a sales transaction until I paid for it. Regardless of my intention.
