My daughter has her father's last name and we have since separated because he was violent and would drink with his friends while he was supposed to be babysitting our daughter and I worked (he didn't have a job). So, in order to do that, would I have to get an attorney or can I just file the necessary papers in the court and go from there?

I believe that you can just file the appropriate papers obtained from the county clerk in your town. You will have to pay the filing fee for the Change of Name. It shouldn't have anything to do with the father as you are not asking for his Paternity to be removed...just for a change of name for the child.

You can file yourself and I believe you have to publicly (in the paper) publish the request and court information. If he fights it you will probably need an attorney.

I would say yes, becasue certain papers need to be filed, unless you can find out what ones and make your own date with a judge.

just go to your local court house and see you may not need one, I really think you may have to do a little paper work and pay a small fee around $ 20 buks or so.

why not go to legal aid and let them help you fill out the proper papers. you want to make sure you do everything correctly the first time, so you can have it done with once and for all. good luck.
