Right now both share the kids and have joint custody, she is no longer working can he get custody since he is the only one with a job?

I beg to differ from dear Alexander. Courts do NOT always go with the mother. It is hard to take a child away from any parent who the child has been solely living with. Unemployed or not if she is providing for the child then who cares. You guys need to get over this thinking that the mother always wins. It's tough to raise a child regardless of the parents gender. The mother may be on public assistance and the courts wouldn't care. I know for a fact, my friend just went through this crap.

I went through the same thing,As long as the courts see who is best for the child it can be the unemployed which I was at the time. Although mine was extreme as there father refused to do what was best for them so I received custody. You may not be eligible to get tax write off until you get a job. As soon as I got a job I was given tax write offs. Good Luck and God Bless

He should, but courts always go with the crap about how "children need their mother" which is sometimes true, but alot of the time thats an exageration. Dad should get them since he's the only one with an income.
