I think that it is when violent offenders are released from prison early just to commit more crimes. I also think that it is when we allow thousands of undocumented illegals come over here and they commit all sorts of violent crimes against the citizens here.

Yes and no. Our (US Citizens) crime is wanting to believe that the best attributes in some people are established in all others. This explains most ills, from electing the elite to represent the working class, to allowing a pot dealer to do more jail time than a child rapist. The USG crimes, and yes, there are many, go well beyond any pseudo-mercy or "not stooping to their level." Alas, your questions was on our crimes...so there is my answer.

it depends up the intencity of crime. like mercy to a person who did wrong against state or any other crime which directly affect the moral of a larger section of socity, then mercy is a crime.

I wonder if that depends on who is showing the mercy.
If the judicial system extending mercy to a great degree then it seems in conflict to what society, collectively, has spoken for.
Mercy, extended by the individual impacted by the offense, is a means of healing. In fact, I have seen it written, "Peace does not come through justice - it comes through forgiveness." And, FOR THE INDIVIDUAL (not the justice system as supported by the wishes of society), I believe this to be true.

If you mean showing mercy to criminal encourages them to commit more crime.
The punishment must fit the crime, it is easier said then done.
The major component of the punishment must focus on the turning the person around and guide him-her to become productive member of the society, when they are out back on the street.

Someone else ask this question about a week ago. I'll give you the same answer I gave them. How merciful was the guy who beat, raped and then murdered a fifteen year old girl? I'd have to say no.
