I was married when I have come here with Uk citizen, so I have worked here for 3 years because I got NI card. but I am not working at the moment and I am spending my own money. I went High school and got HND / HNC qualification and several qualification. I just can't go to my country because I lost my everything at there and came here with my wife and everything went wrong. Now no visa no job and no money. IF I apply for High skilled immg visa after all what is my chance or will I get depertod? Can some one help me please?

At first I thought "You cheeky git! Expecting bona fide citizens of the UK to help him/her conspire to break the law and stay here".

Then I thought this has to be a wind up because you are going to get all sorts of anti immigrant, pack-em-all-back-where-they- came-from comments from the less friendly sections of the UK Answers contibutors.
However, the facts, as described, you suggest that you have no leave to remain in the UK and you should return to from whence you came as you are here illegally. Surrender your NI card and report to a police station where they will arrest you. Alternatively, turn yourself in to the authorities at once so that they can process you and send you back with immediate effect. When you have returned to the country of origin, then you can apply to the British Embassy or Consulate for proper documents that will allow you to return and perhaps stay. You could even apply for British Citizenship if you have skills that make you a positive asset to our country.

If you apply for HSMP, you have almost no chance of getting it, as your qualification is too low. And there is a chance that you can get deported.
When you came over to UK, were you legally married to a UK citizen? Did you apply for the marriage visa? If not, that's what you should have done. If you have , have you got it? If you have got it, and if you and your wife were still together after 2 years, then you could have applied for Leave to Remain Indefinite (Permanent Resident Permit.) I am wondering if you and your wife are still married now, because if so, you might be able to sort out your visa as her husband.
Only having NI does not entitle you to work in UK unfortunately, since you need a visa that allows you to work. If you want to stay in UK legally and work, then you have to get your visa sorted as soon as possible. Pick up a TNT magazine or go on the internet to look for immigration law firms. There are many of those. And contact them, explaining your situation honestly, since there's no way you can go around by making up stories when it comes to this. Sometimes they can sort your case out on no win no fee bases. Also contact Immigration Advisory Service, as they are specialist charity group that even can help overstayer to rectify visa situation.

Legally, you cannot.

The fact that you can get an NI Card without the authorities picking you up says it all about the true situation.

I hope you will understand that as a UK national it worries me that our authorities do not know who is in the country. It makes issues to do with potential terrorism and health risks such as "bird flu" very difficult to guard against. Such issues - and their effects would be as disastrous for overseas people here as much as everybody else - are perhaps even more important than the regulation of jobs.

there is not any danger what so ever which you will get a paintings visa in case you have overstayed for 2 years. additionally on leaving the country (in case you are able to with an expired passport) you have a lot of explaining to do...

I have read all the comments so far & some I agree with & some I don`t.But the important thing here is how did you get here first was it, from a war ravaged country? or did you come via the channel tunnel? either way there are going to be problems, were you given a time to stay legally?if so go back to source & explain your dilemma if on the other hand you are totally here under false pretences then it is time to make a fresh start with your life come clean & be honest with yourself & others for once.

If you've lived here for 9 years then I guess your fully integrated.
But I think it's about time you contributed to the nation i.e pay your taxes and things.

As you obviously don't have a criminal record (you would have been thrown out by now) then it will be OK for you to become a naturalised citizen.

Contact the Home Office and make an application.

P.S. I believe the Home office is considering doing what they have done in the US and give an Amnesty to illegals. If you live and work here you are entitled to pay your way and recieve the benefits of being British!

I have a totally different view.
participate in some healthy lottery and if you win a jackpot, with this lots of money you could buy over some economic interest that would eventually give you lasting entrants to the UK.
after this, go back to your home country then apply for re-entrance with your new profile and economic health yu would be surprised to receive a multiple entry visa.

or try the penitentiary.

oh what a shame, you have to spend your own money,instead of being able to claim social benefits like a lot of the other immigrants and asylum seekers.
you are an illegal immigrant and should not be here, so do us all a favour and go back home, we are overcrowded already and do not need you.

therefore no right to be here

however...

you wouldnt legally be able to get any work.as most employers ask for some kind of proof of legitimate right to work in UK, especially with our present open doors policy.

can only say cash in hand work at minimum wage.
which is your own fault as you choose to overstay and therefore put yourself in this position.

i am not against economic migration or any other type. my husband has been here for 7 yrs, came over as a student.
but illegal immigrants are different kettle of fish.

1st go report to the police,then go straight to jail,do not pass 'GO'.Prove that you been in UK for the stated period of time;this of cause will get the people in a lot of trouble not to mention jail term.Anyway so what if you got a NI card....does this mean that you been living off someone else?
