Am I entitled to lost wages??? My car was possibly totaled on the way to work last night and I wasn't able to drive it to work (I also live 32 miles from work) and was pretty shaken up, should I be able to get remibursed since they found the other driver at fault? I work 3rd shift in healthcare and was in no condition to provide medical attention to patients.

Possibly, if the other party has liability and you can prove employment and salary (timecard, W2, etc). A lot depends on the mood of the claims adjuster as how settlement can go. I would advise being as civil and professional as possible, even if you feel the need to speak to the manager. The adjuster will appreciate your attitude and be less defensive if you are reasonable. Trust me, you cannot believe what adjusters are bombarded with eight hours a day, five days a week. Someone that actually appears to want to work WITH them vs combat stands out.

The answer is yes if you get a lawyer and able to sue the person who hit you. A day of loss wage is nothing compared to you being alive. Go to a doctor and get a good check up.

You should check the law in your state for specifics, but basically yes, you can collect for lost wages due to injuries. But not for days you simply couldn't drive to work because your car was damaged. You're responsible for arranging for a rental or other transportation.
