We are in the same predicament. Just to let you know if the father gets the kids he has every right not to give them back without it being kidnapping because there is no custody. We took his exgirlfriends 3 yr old from her and there was nothing she could do. But there were reasons why he took him, he felt he was in a better place with us. So until there is custody I would be careful.

Temporary custody is awarded by the judge before the actual custody battle ensues in family court. The judge decides which party would be safest and will also sometimes award temporary visitation rights to the other party.

whoever gets the child before the judge depends on the parents. if the mother is better for the child or the father, due to housing and income and time spent with the child. majority of the time the mother.

In the State I live in Until paternity has been established in the court the child belongs to the mother even if the parents live together. Try doing a search and finding what the law is in the state in which you live

the child stays with whoever can provide everything it needs until custody has been granted. it depends on a lot of material things believe it or not , like money , food, living quarters schools and how the child reacts to where she or he is at

Always the mom, unless she doesnt want them then the dad but sometimes the dad doesnt want the child either so then the kid usually goes to their grandparents.

It depends on what the agreement is that they have reached together. It's not automatic that the mom or the dad gets custody.

It is usually the mother because she is most times the primary caretaker of the child. Most times the man/father leaves first anyway.
