after 35 mins on 400 degrees in oven they are still pink.

Aluminum is a poor heat conductor. It can actually be a heat shield. Notice that KFC always wrap their corn on the cob in aluminum foil to keep them warm.
If you're just cooking hamburger patties, I suggest that you use a BBQ or just pan-fry and not in the oven. If you must use an oven, line the bottom of your oven with aluminum foil then put the meat patties directly on the rack; Broil to seal in taste.

The hamburger must be touching the bottom of the pan without anything in between like the aluminum foil.
The meat is not cooking because the heat of the pan is not fully reaching the hamburger and the foil you have on the bottom of the pan is diffusing the heat.
Therefore, do not use foil on the bottom, put the meat directly on the pan, watch your burgers so they don't under or over cook Turn them over so they cook on the other side. Hey, grill up some onions, put cheese, if you like, on top of the burger once you've turned them over, cover the pan with a real cover so that the cheese melts, add tomato and lettuce before serving. Mmmmnnn. Delicious.

The foil is reflecting the heat so that it doesn't get into your patties. Leave the hamburgers uncovered to cook them. Remember to flip them if you want to brown both sides.

because it is trapping the heat in the inside and your not letting it get air take the top off
