Connects in with 3 things:
From Modern Sociology's viewpoint [which all lawyers and judges are instructed in], they are taught to favour the 'descriminated against' - ie. the "Minorities", or the down and out, the 'downcast' of society. Their life's stories are now treated like royalty.
The perspective or philosophy behind it all is referred to as, 'Secular Humanism'.
So, the 'normal' law-abiding citizen is treated with more suspicion re motive, etc., than the criminal.
2. This Humanism is locked into the concept of Evolution of the Species.
They tie the 2 disciplines these days.
The belief is that as man has evolved from an animalistic past, we need to exercise understanding that criminals are just a little behind some of us in their evolution, because we cannot call them, 'bad' or 'wrong', because there is no such thing as objective right or wrong.
Right and wrong have simply evolved, as Man has evolved.
Therefore, because we are all evolving, right and wrong are individually owned, according to one's level of personal evolution!!!
Criminals are technically just treated as "deviants from the norm".
They are not bad; or have not been bad; their behaviour is treated as a product of their upbringing and past life's experiences.
In other words, it is considered that if you were brought up the same way, you would be just as deviant as they are!!
3. Is the old Hip Pocket [OF COURSE}!!!
Criminals are what keep the justice system in business.
From the Judge's perspective:
'If we get the case over with too quickly, we all lose what extra money we could all have made from this whole court case.'
So, the issue is rarely treated now as 'straightforward'.
Further, if the lawyers and judiciary can see that the plaintiff has money, they will tend to bleed the case for all it's worth!
SO RESTS THE JUSTICE SYSTEM OF MOST OF THE WESTERN WORLD TODAY!!!

Because all have a right to be innocent until proven guilty and the system is such that until one does offer proff, often the victim is placed in the role of instigator.
