All aspects of the bureaucracy are slow, but Immigration has to be the worst. Just ask an asylum-seeker that's waited five years to be interviewed about their case.

Have you tried contacting your MP about this case? This would especially apply if you felt that his continuing presence was threatening to you, as opposed to you simply wanting vengeance on him.

I must say, the religion of the solicitor is irrelevant - if you can pay, you will always get a solicitor to act for you, even if the case is hopeless.

From what you've said, his spouse visa has expired, and he has no grounds for applying for settlement on the basis of continuing marriage. He can of course apply to stay on some other grounds, but normally such an application should be made from the home country. He may have applied for asylum, but it's very unlikely he would get far with that.

He is allowed to remain while any application is being processed, but in the end his position is likely to be untenable. Life without papers can be pretty crap, and in the end he'll be sent back - but it might be a good while coming.

Hope this helps
