I asked this question before but didn't get the answers I expected.I needed to know if a father can give up his parental rights with out the consent of the mother as far as trying to dodge a child support case. Thanks.

Giving up parental rights does not mean he doesn't pay child support, he just can't participate in decisions for the child and other rights are taken away too, like where she lives or how much he can see her.
Why would anyone want to dodge child support, he should have tried to dodge getting her pregnant if he didn't want reponsibility.
If he wants to know more just tell him to consult an attorney, he doesn't have to hire him/her just go for a consult and maybe he will get a few tips

The law differs on this from state to state. However, in most cases, the biological father can sever all ties with / to the child without permission from the biological mother.

If he does relinquish his rights, then he will not have any legal financial responsibility for that child. However, he will not have any visitation, inheritance, or decision-making rights for the child either. The biological/custodial mother would still be notified of the proceedings by the court, but there usually isn't much that can be done to deny his petition.

He can give up his rights, however he will still be ordered to pay child support, you must go through division of shild support to get a order set for payment. Parental rights, custody, and visitation are completely differant that child support. The court will not even entertain any child support questions in a custody, visitation or parental rights case. SO yes he can give up his rights but he will still have to pay, he cannot dodge child support by giving up his rights, he is still the father of the child. Visitation and child support have nothing to do with each other in court. He can be denied visitation by the court and still be ordered to pay. So if he ever says "If you don't let me see my kid I'm not paying", laugh at him and march yourself to The Divsion Of Child Support Enforcement. I hope this helped you. Remember child support has nothing to do with visitation or custody.

No. A father can give up his parental rights if he chooses to do so, but he is still obligated to pay child support unless the child's mother signs her consent.

I would think that it might very from state to state. I don't think he can just give up his parental rights. I have heard of cases where even if a man was not the biological father (he thought he was) he still had to pay child support. He would still owe back child support, even if he could give up his parental rights. Call family court, they might be able to give you the best answer.

I am going through the same thing right now with my childrens father...he signed all rights over to me -- he has no rights to the children visitation or anything but let me tell you the state still went after him for child support as a matter of fact we go this week to court for child support so no he stills has to pay unless you do not want it.

I think a father can give up his rights without the mother's consent, but I don't think that gets him out of paying child support.

Seriously though you should probably ask a lawyer.

in maine once a father gives up his rights to his child he does not have to pay child support. He can give up his rights at anytime with or without telling mom. If he is giving up his right to avoid child support I am not sure what could happen I suppose if you could prove it there might be something you could do. This happen to a friend of mine, he sold his child out b/c he did not want to pay child support. It is a very sad statement..I think they should have to pay anyways.....

No they can't give up any parental rights to dodge child support. They must pay child support.

A father can give up parental rights anytime he wants but he can't give up obligations such as child support.
I have full custody of my daughter he has reasonable rights and we agreed to child support and had an order put in place.
