Hi guys, I just got pulled over doing 58mph in a school zone posted at 35 mph. This is my first ticket ever in the state of NY, my record is clean. What can I expect?

Big Time Fine and a possible loss of license. Don;t know how NY is on speeding through school zones are. Best advice is to see if you can go to a Drivers Improvement course. This will cost you a few dollars but will erase the ticket from your record.

SLOW DOWN in a School Zone. While I dont live in NY you would have royally PO'ed me if you were speeding through a school zone that my kids go to !!!

Kids are unpredictable. You dont know what they are going to do. One second they are well away from the curb, the next they are in the middle of the road. You have to be extra careful in a school zone.

Probably not guilty. If the lights are authorized to be on between certain set times then that is when the speed limit is in effect. Even if the lights were flashing after that time the speed limit is controlled by the law. The lights are just a reminder. If you got your speeding ticket after the end of the reduced speed limit then you should be free and clear and the cop was in error in writing the ticket. The same applies to stop signs. Not all stop signs are legal. For a stop sign to be erected there has to be an ordinance or law authorizing it. If you run an illegal stop sign you cannot be found guilty of running a stop sign. Places where this might happen are in shopping center parking lots where the owners might put of stop signs on their own without local ordinance to authorize it.

You should probably expect to get hammered. The courts don't take to kindly to endangering the lives of children.If it was your first ever offense, the punishment may not be as severe, but since it was a school zone, you will be paying a hefty fine more than likely. Good luck to you though, and slow down. Take your time traveling through school zones instead of running the risk of facing a homicide or manslaughter charge.

Well besides the fine being high for the school zone violation it will be very hard to protest against in court. The judge is not going to have any sympathy on your side for the school zone violation. Take traffic school to avoid high insurance rates. New York Police are known for writing bogus tickets. I got one in Nassau county for not using a turn signal. The cop followed me for 5 streets and thats all he could get me for.

To plead guilty, pay a fine and receive demerit points, and be glad that it wasn't over 25 m.p.h. because that's a felony.
BTW, school will erase the points but, not the infraction. It will still appear on your license but, it will say that the judgement was deferred. I possess a CDL and they only go away when a three year limit passes however, they're still on your permanent record as deferred. Insurance companies only go back 3 years.

A very high fine and additional points on your license because it was a school zone.

I would take an attorney with me to try and get it reduced somehow

Im not sure what your state law is, BUT you will surely get a hefty fine. WHY would you drive that fast in school zone? Trust me, if you had hit a child your problems would have been way worse than paying a fine and having your insurance rate skyrocket...
