In most states you are legally drunk if your BAC (blood alcohol content) is over 0.08%. In some states it's 0.1% (Nevada). That's a state specific question.

.08 is the legal limit however you can still be arrested for DUI with any amount in your system if you fail the FST. You can also get poped for perscription and OTC meds as well.
