I'm a temporary legal resident. I should become a legal resident in 2008. I obtained my residency through marriage. Before getting married, we dated for 3 years and we got married at the beginning of this year. After we got married, things started to change and right now, things are not going really well; if we separate and file for divorce before 2008, am I going to be deported? Can my job sponsor me?
Any thoughts?

If you are a Conditional Permanent Resident based on marriage, you may be able to file a waiver to remove conditions on your own, even if divorced, if you can prove that the marriage was entered into good faith. You must however file to remove conditions either jointly or separately or face deportation procedures.

i have a friend from romania that got married and then divorced because her husband got abusive. she`s still a legal permanent resident here, but she has a lawyer taking care of things. i think you have to show evidence on why the marriage didnt work so they can make sure you didnt just marry to get into the US

How did you date for 3 years if you got your temp residency via marriage? Your story doesn't make sense.

A spouse still on his/her temp residency can apply for a waiver to the two year residency requirement based on extraordinary circumstances..... physical/emotional abuse, death of citizen spouse, etc.

You really need an attorney if you go this route.

It depends on the circumstances. If you can proof that the relationship existed prior to the marrige, you should be able to keep your green card (or specifically have the conditions removed). Either way, get an immigration lawyer, this is getting to tricky to handle on your own.

You have to go with Alie's answer. It is correct. Someone I know just did this. They dated for a couple years, got married and she cheated on him. they got divorced, and he still was able to get conditions removed from his green card.

But get a lawyer to help you.

I don't think you will get your legal residency because they can base your marriage on a fraud.

you should not have been here illegally to start with,get the divorce and go home,take her with you. deported is what is going to happen,leave on your on and you have a chance to come back.
