I'd appreciate any input on this serious situation.

My sister, together with her live-in bf of many years, runs a small landscaping company. The workhorse of this operation is a beautiful Dodge Ram truck, which is in her name only.

The bf has a LONG record of doing stupid and dangerous things. Last night, my sister asked him to go to the store. He allowed his 17-year old son to drive him, and he insisted on taking the Ram (other vehicles were available).

On the way home, contrary to explicit instructions, the bf allowed the son to make a side trip up into the country. In the process, the son rolled the Dodge. The Dodge is now totaled.

She loved her truck. When the bf & son explained what had happened, she began to cry, and scream at them, calling them idiots. The son smart-mouthed her, using vulgar language, and my sister slapped him.

The bf, fearful, took the son and dashed off in another vehicle, leaving my sister to deal with police & insurance.

What should she do?

I just hope she told the police the truth of what happened. The bf and son may be charged with leaving the scene of an accident but they probably deserve what they get. The bad part is no matter what the dodge cant be replaced. Your sisters reaction to them about what happened is normal and should have been expected but the son had no right reacting the way he did to her other than being young and stupid. Now if the bf and son didnt have a drivers license or not and taking the truck without direct permission, could constitute vehicle theft. I hope she realizes her bf is irresponsible and inconsiderate towards herand shouldnt be trusted til he proves otherwise. Good luck

its sad but you gave the man the keys so that limits what you can do .
you have reported this to the insurance and the police and that is fine . the police can give you some advice about this matter but i am sure they will tell you about your giving of the keys.
but they may also have some addtional helpfull advice for you .
if they dont then phone a lawyer and ask if there is anything more he thinks you should be doing about this . state to state and country to country the laws are different so the legal advice is the way to go . dont get caught up with a lawyer who wants a stack of money just to give you a couple min. of time . all you might need in this case is 5 minutes of help from a lawyer if any.
good luck . sorry about your truck. just be glad no one was hurt and most importantly that they didnt hit another car or run into some one or something that would be a great deal worse

She needs to file a report against him with the police telling thwm that he was driving and she only gave him permission to go to the store, no where else. And the isurance company if they do not pay, she can sue him for the money, because he only had permission to drive the truck not his son.

She should file a claim with her insurance and replace the vehicle and apologize to the boy.
