Yesterday morning on the bus some my boys hit another boy in the head with a beer bottle. Of course they started fightin, but when the police officers came on the bus they threatin to spray the whole bus with pepper spray. They actually did spray the entire bus, some students had to go to the hosptal for havin asthma I think. Now the mother is ready to sue somebody? should she?

The police have to get things under control and quickly in a situation like that. You already have one child injured and possibly more. I'm willing to bet the little darlings did not settle down when the police came on the bus. Unfortunately, the innocent also got sprayed. The mother that should do the suing is the mother who's son was hit in the head. She should sue the other boy and his parents.

The whole bus could sue the police officers.
They went too far in spraying the whole bus with pepper spray.
Pepper spray is only needed for the person making a nuisance, not the victims or witnesses in the area as well.
If they wanted to use the pepper spray then they should have taken the boys off the bus and sprayed them then if they got out of hand.

Was everyone on the bus envolved in the fight? If not, did you (the bus driver) let the officers know who was not envolved? If yes, then why weren't the ones that were not envolved removed from the bus? the mother who wants to sue, was her child the one that got hit by the beer bottle? If yes, then wasn't he removed from the bus? If the boy who got hit by the beer bottles' mother is the one who wants to sue then YES she should sue the police officer. You may not like what I'm about to say though she should also sue or press charges on you, because you did not do anything to protect this child from getting hit by the beer bottle or being sprayed with pepper spray!!

No she has no grounds to sue, if they were sprayed, even asthma will not be seroiusly effected but would be sent to the hospital for a check. Everyone else would have to be flushed.

If the people on the bus were not obeying the commands of the officers, yes that would be the property procedure.

The mother should worrry about what her child was doing, not what happened when the police came to protect them

If the activities are precisely as you describe, i could think of it is regulation college one 0 one. talk over with an lawyer. make confident your geese are all lined up. One small blunders can harm your case. out of your description, you ought to have a case. purely considering you refuse to open the door for them, it particularly is no longer in all risk reason. anyone can knock on your door and say they are the police. it particularly is stated as a house invasion in the event that they are actually not the police. belongings proprietors have been shot in AZ via abode invaders who have been donning fake police uniforms. Err on the part of warning.

you CAN sue for anything...dosent mean your going to win... and the mother who wants to sue would also sue the police for NOT spraying the whole neighborhood if her son was the one attacked with a broken bottle, would have said the police didn't do enough to protect her kid

I think that there are some facts of the case that are unclear..........if the police is in the wrong I am sure that there is someone out there that is going to jump on it and make sure that either they or the school is held responsible. There seems to be room for someone to place blame somewhere and that is most likely what is going to happen. Let the finger pointing begin.

Yes she should, but it most likely will do nothing. They are the police. In my experience with the punk pigs, the only thing they understand is violence. Try speaking their language next time by punching one in the face or smashing ones head with a brick or large stick. They will get the message then.

My comrades and I shall continue this assault. You wanted a war pigs? You got one! You think I am joking about fighting back when a cop gets rough? Try me! I can't wait for next one that crosses my path. Punk b!tches...

It depends if her child was actually involved in the incident. If he was, I would certainly be embarassed by that fact that I wouldnt sue. That would mean my own son caused all that to happen. Some people need to take some responsiblity for thier actions and realize there can be consequences.

I don't think the police should be sued. The boy who was hit should press charges and sue.
