If you were not damaged or harmed in any way you can't sue. You should take it back to the store with what you found and the package it came in and they will probably replace it for you.

complain and get some free stuff. mistakes happen, and so did this piece of rubber. if everyone sued because of innocent mistakes we would all be in court.
