I was in this situation with my husband and his son and he had no control over it....they said that if that is where she wants to work and live then tuff patooty!

Depends on the custody agreement. You could have him sign a child release form or contact social services in your current town for assistance in getting full custody. If he only has visitation you only have to provide your address and leave the rest to him, but if it's supposed to be shared there is paperwork involved. Also by contacting social services they can list him as a deadbeat dad and garnish his wages when he works to get you some of what is owed. Good Luck!

What does the court order state?
Child support and PARENTING TIME are TWO seperate issues, if he is not paying support - that does not mean that he can not see his child.
Why does it all boil down to CHILD SUPPORT? How about how the kid feels - does he want to move ?
You didn't say IF dad DOES see the kid?

It depends on what sort of custody you have. If you share custody then no you cant. If you have solely custody you will more likely be able too. If the father has vistiation rights then you will have to provide him with where your going etc. The best thing is to talk to your lawyer.

does your divorce order say you cant? it usually doesn't. there are stipulations added for visitations for parents that live 100 miles apart or more. the father really doesn't have a leg to stand on and there is usually no stipulation saying you can't. read your divorce/custody papers. talk to your lawyer if you are still not sure.

Yes, but if he does file in court, he will also be forced to pay child support. It may not be worth it for him in his eyes.
