I'd appreciate any input on this serious situation.

My sister, together with her live-in bf of many years, runs a small landscaping company. The workhorse of this operation is a beautiful Dodge Ram truck, which is in her name only.

The bf has a LONG record of doing stupid and dangerous things. Last night, my sister asked him to go to the store. He allowed his 17-year old son to drive him, and he insisted on taking the Ram (other vehicles were available).

On the way home, contrary to explicit instructions, the bf allowed the son to make a side trip up into the country. In the process, the son rolled the Dodge. The Dodge is now totaled.

She loved her truck. When the bf & son explained what had happened, she began to cry, and scream at them, calling them idiots. The son smart-mouthed her, using vulgar language, and my sister slapped him.

The bf, fearful, took the son and dashed off in another vehicle, leaving my sister to deal with police & insurance.

What should she do?

since her bf was living with her at the time, i hope she had him on her insurance. it should be covered under her insurance since he used it with permission. as for her bf...she needs to get as far away from him as soon as possible. he is worthless and if he will run after that, he'll run from any problems in the future. good luck to her

I don't see that there is much she can do. Permission to drive the truck was given. All that is left is to file the police report, which should be done by the driver, and also with the insurance company. The insurance will also want to talk to the driver concerning the incident. A civil lawsuit might be appropriate assuming that the boy friend has any assets.

If his son wasnt licensed, she should call and report the truck stolen. I know this is a lie ( sort of) but she needs to get reimbursed or she is gonna be in serious financial trouble.

Tell the police exactly what happened and then sue the hell out of the bf and son.

Tell the truth. tell them she lent it to him and in no way gave permission for the teen to drive it. That should hold him liabel by law and HIS insurance should cover it.

A truck is replaceable,your sons love and love for him is not.

She should get another truck and not let anyone drive it except her.
