IF you are CERTAIN it is infectious then yes, you do have a right to ask her not to come in as you have a legal obligation to protect the health and safety of ALL your staff. However, be very, very careful because your 'self-diagnosis' over the internet is NOT acceptable as "proof". If you have access to an Occupational Health department/ adviser, you should ask them to intervene in this case.

Check with the DHSS, but I'm pretty certain you can ask her not come in until the illness has passed. They can send kids home from school if they think they are not well enough to be in school and I think Nurses and people who work in the catering field aren't expected to come if they are infectious. I think you'll find if she went home sick it is highly unlikely she will be in tommorrow. The only trouble is she came in today so you and your other staff could already be infectious and be going down with the infection.

I'm not sure if the labor laws in your area will allow you to demand she not come in. Since she is a temp, the first thing I would do is to contact the agency you have acquired her through and discuss it with them. If they can't convince her to stay home, make it very obvious that her entire workspace needs to be sprayed with Lysol on a regular basis. She may not be able to afford to lose the work and the money, but you can't afford to lose other employees because of her inconsideration.

Yes, you can tell a sick employee to go home. Simply state, "You don't seem to be feeling very well today, I'd like you to take the rest of the day off. If you are still feeling bad tomorrow, you may have tomorrow off as well."

I'd have thought you were within your rights to request her work only if she has a doctor's certificate saying that either she is not ill or at least not infectious. You have a responsibility under H&S to your other employees.

If he/she is a temp then all you have to say is that you don't need her/him in for the next two days. Notify the agency and tell them you don't need her for the next few days and ask them to send another temp. After her illnes is gone you can take her back and send the other temp away. That's why they invented temporary workers and that's why it is expensive to have one.

yes you have the right to send her home.. the true question that i can not answer is if you have to pay her for the day..a concerned boss would just pay her, and protect the rest of the staff..

if she is a temp ..all you need to do is ..tell the temp agency she is not needed tomorrow ..or until further notice.. but explain to the agency the reason you don't want her in ..or otherwise they get touchy and not send any more temps to you ..
