I got a speeding ticket and my weight on the ticket is incorrect. I don't mean by just a few pounds either. It is wrong by about 100 pounds. Can I get it thrown out?

as a police officer in the army i can tell you that it will not get thrown out for your weight.Sorry to tell you that but the only way it will get thrown out is if you beat the ticket, by proving you were not in the wronge,, and if the officer was using a radar gun when he clocked you,,the best thing for you to do is pay the ticket and see how to get the points took off you license I.E. driving school

We don't put height and weight on a ticket here (Ontario, Canada). In this part of the world the only thing that will get a ticket thrown our are omissions (blank spots). Usually (depending on the JP you get) any errors can be corrected in court during a trial.
If the police officer that gave you the ticket can say they confirmed your identity with your photo driver's licence at the time then the fact they he/she is a bad weight guesser probably won't matter.

It could be argued that if the officer issuing the citation didn't get your weight correctly that he/she didn't get your speed correct either.
However, this defense will probably only:
A. Irritate the judge, who has heard this countless times before.
B. Amuse the other people in the courtroom, which can be embarrassing.
C. Reduce your chances of getting Traffic School and having the ticket dismissed.

I would ask for Traffic School, get the ticket dismissed upon completion, and go on (albeit a little more slowly) with my life.

Probably not. If this is your first speeding ticket then show up in court and ask the judge to let you go to a Driving Improvement Course. Otherwise pay the ticket and learn to slow down.

No. You can try and contest it based on the wrong weight, but you will more than likely piss the judge off and a $75 ticket may turn into a $150 ticket.

no, but you can petition it, then it will probably get thrown out? Unless you were going 30 miles over the speed limit. anything under 30 miles petitioned will get a reduced fee or thrown out. But be nice about it. Don't cloud the issue - speeding is speeding. The cop didn't care what you looked like.

Sorry, but no. If it were something major--like the location or date, you might have a chance. If you go to court and try to use the weight excuse, you will be wasting the court's time and they do not look favorably on that. It could come back worse on you than just paying the fine.

Only on LAW AND ORDER. Pay it and forget it. ps. If you are looking for real trouble get one of those radar scramblers as advised above. Your fine for the speeding ticket will be minuscule !

I'm not sure about that. Don't they get your weight from your driver's license? I don't think that by itself is enough to get it thrown out. If it was your weight and your hair color and he said you were wearing glasses, I think that would make it sound like he had the wrong person and it could get thrown out.

Negative. The magistrate or judge could just chalk it up to and error...along with the officer's testimony that you were in fact the driver
