Can anyone answer my question, i can't find the answer. Many Thanks

It is my brothers so called debt and he has moved and is a resident of the USA now, we give the company his new address but they keep sending baillif letters to our UK home address. Should this debt follow him, as we have an address for him or will it stay with us in the UK. Many Thanks..

The laws of each country are different, but the U.S. and U.K. have many that are the same. It depends on what type of debt it is. If it does not involve the real estate, the debt is his and his alone. Only the person who signed is responsible for paying it.

Creditors tend to send letters to the last known address. And if your brother moved to the U.S. that is not like moving across town. They can not collect from him if he has moved out of the country. They will have to just write it off and close his file.

Now the only time there could be a problem for you is if the debt was a mortgage or a loan on some personal property like a TV or something that you have possession of. The creditor would have the right to take action to get their property back. But from your question I did not get the sense that it was that type of debit. So when the mail comes I would just write on it "return to sender, addressee is no longer at this address".

No, only the person who created the debt. It does NOT follow the family. You cannot make someone pay a debt if they did not sign the contract. The other answerer who said that is wrong.

in the USA ,it follows the single person responsible or the husband and wife as a team.
if married and one was late on a house payment its on the others record.
goes by social security numbers which are linked in a marriage and then separated at divorce.
if your married or divorced.. best to get all 3 free credit reports and make note if there are credit issues.
idf divorced or clearly one persons fault..someitmes the credit can be erased from one . but youll need help to do that most likely.

im afraid to say alot of the time if u have a debt it can follow u even if u move but sometimes if its not alot of money and they dont no your new address sometimes the compaany right it off as a loss it costs them alot of money to get u tracked down then get a good enough court case then there is the cost of that and alot of the time they cant be hasseled with all that but if its alot sometimes they can find you good luck iv been there myself and heard nothing about it at all

It follows the person. In the case of death the person who died assets (house, car, bank accounts) could be taken for payment of debts. That is something that would go through a probate court.

I am afraid it is both, if an address is known to have had bad payers living there you will find it hard to get credit, also debts will follow you if you don't pay up

it should follow him, however the letters will come to the "last known address", especially when someone with the same surname is living at that address. you will probably have to pay one of the credit reference agencies to "divorce" his name from the address.

write to experian and dissasosiate yourself from his finances no one can remove any of your goods from your house dont let them fool you try find experian on the web i not sure of the spelling but i have had major debt probs which are now sorted so i know this is true

get in touch with your selfish brother and tell him to get it sorted...how can he just leave knowing he has left this behind him..get in touch with the debt company and threaten them with a suit if they do not stop harrassing you
