I drink in moderation and I never drink and drive. Of course people who do drink alot make lots of claims about sucking on pennies etc. One thing they said was that if you drink and drive and get pulled over you should refuse a breathlizer and ask for a blood test? Can you do this? Would the wait between getting to the hospital effect the Alcohol content in your blood?

I believe it depends on the state but in the good 'ol state of Wisconsin you can absolutely request a blood test instead of the breathlizer! I have done it...a friend and I were pulled over for a tail light being out and the officer suspected me (the passenger!) of being drunk (apparently because I was smoking and, you know, people obviously smoke to cover up the fact that they have been drinking!) He thought he was going to bust someone for underage drinking...ha, not only was I not in the least bit intoxicated but I refused the breathlizer and had that blood test done which only made him look worse! And p.s. none of the "cures" such as sucking on a penny work...take it from a college student who has had much experience in the drinking field!

In most places, part of the agreement you made to get a drivers license implies that you will consent to a breath, blood, or urine test if you are suspected of driving under the influence of drugs or alcohol. Depending on the agency performing the test, they may or may not have all 3 of those options available. You should submit to whatever test they have available, but remember too that you still have the right to have an independant breath, blood, or urine test to determine your BAC. Most agencies will provide transportation to a health care provider that can administer the independent test of your choice, but you have to pay for it. As far as the waiting effecting your BAC, that really depends. Some people drink a lot fast and are arrested while their BAC is still on the rise and may actually be more intoxicated by the time they are tested. Some people may be arrested say on their way to work the morning after drinking all night, so their BAC may be on the way down.

I think it might depend on your state's laws. Technically... if you refuse a breathalizer test here... you loose your license. True, if you are allowed to wait till you get the blood test, the results should be lower. However, if you show any alcohol in the blood test, a "good" prosecuter could extrapolate the true blood content back to the time of apprehension. Not sure if that has been done, but I would try it if I were prosecuting... anything to keep drunk drivers in jail where they belong!!!

In my state, that's not an option. If you refuse the breathalizer which is not accurate enough for evidence anyway, then they give you a field sobriety test which is video recorded. Then they take you to jail for an intoxilizer test. if you fail that, then it is admissible as evidence. If you refuse that then you lose your licsence for one yr. and the judge can go by the video of your field sobriey test and you can be convicted of a DUI. Those field sobriety tests are difficult if you are sober. For instance, the officer will tell you to hold your right foot off the ground for 30 seconds and will have you count to 30. If you pick up your foot before he tell's you to then you were not listening to his instructions if you count too fast ( he times you btw) then it shows your sense of time is impaired. It's better to be compliant with him and get a good attorney...

It could but if your plowed then your going either way and by requesting the blood thing your sure to piss the cop off. I had never heard of the penny thing but I don't drink so maybe that's why.

yeah it gives your body more time to digest the alcohol, you body only digest about 1 oz of alcohol per hour so.. if you have been drinking heavily your just buying yourself another hour or so before the slammer, but if you have only been drinking moderately it could very well save you. You waste your money on that stuff you could do something better with it... Not to charity not to save a life ... for you
