I assume you're talking about holding your W-2 - no, they're still obliged to send that to you by the end of January 2007.
They could hold your last paycheck if you don't already have it, or could sue you for the money though.

The IRS would just laugh at their request. Only government units get the right to garnish your tax refund.
If you don't get your w-2 by Febuary 28, call the IRS. Just keep your last paycheck stub to show what you paid in and get permissions from the IRS to file without the W2
