okay my sister separeated from her husband nearly 12 months ago. he is being a real prick first he accused my father of molesting mt sister! he then got someone to ring my gandfather and accuse him of the same thing! now my 8 yr old nephew has accused me of molesting him where does a 8 yr old come up with that word!! anyway he told my sister that it happened 18 months ago. and that i sucked his doodle and he played with my boobs now ever since those kids were little they have always touched everyone breast's and i have always told them that you can't do that to women that it's not right!! i have never done anything to my nephew i wouldn't even think about it, it is wrong. DOCS is looking into it atm!! i need to know every possible thing that could happen to me please help me!!!

A lot depends on the jurisdiction where you reside. What happens here is that an investigation is done. Children who make those complaints are believed, for their own protection, right from the beginning. Thankfully so.

The next step is that the child's story should be evaluated through a course of interviews. In this way, trained professionals will be able to evaluate the truthfulness of the child's statements. They do look for children using terms that should be unfamiliar to them (like molestation). They will also interview the adults who are connected to the child's story. They will, or should, do background checks on all connected parties. They look for consistency in the stories - they also look for too many consistencies - like telling the story over and over, in exactly the same words, as if rehearsed or coached.

They will and should also look at who seems to be the central figure in the whole mess. Like one adult (in this case, your sister's ex), who seems to be pointing a finger in too many directions.

Your question sounds desperate, and I can understand that you feel that way now. It is an awful accusation, if it is not true and you are probably emotionally overwrought. Just take a deep breath, contact an attorney to protect your interests, and don't panic. You will get an opportunity to tell your side of the story, but you want to be sure to be in complete control of yourself when you get your chance.

Go see a lawyer and make a complaint down at the police department, you need to have a paper trail showing that you made some kind of attempt to show harassment by an individual and committing slander , but leave out the playing with boobs part , for now anyhow, this will work for you in court , if there is any court appearance. You need to show that you where of concern and innocence, and that someone was trying to hurt you because of a bad break up. find out if your sister has filed any charges on him, this will also help , when you file. This is what attorneys call ,"A DIVORCE GONE WILD !" and it is
much more common then you might think..Child protective services spent a lot of time trying to determine the truth..No one wants to see a child abused, nor do the police or DOCS want to wrongly accuse someone of such a serious crime..

The first thing you should do is talk to a lawyer of your own..not your sisters, not your fathers, but someone who has only your well-being to consider...

Once the divorce is over, and all the mudslinging has stopped, have your attorney sue the hell out of the ex-husband who put his child up to this....revenge is sweet, and can be profitable if you do it right..

until law enforcement officials actually come to your doorstep and begin asking YOU questions, I would ignore the accusations.

If your ex brother-in-law goes public (moreso than he already has) with these false accusations, you can sue him for defamation.

You can be more proactive, however, and send him a letter asking him to make a complete retraction, cease the accusations, etc... otherwise you will sue him.

You can get together with your father and sister, file suit for intentional infliction of emotional distress, and also go to court and file a petition for a restraining order against him.

With regard to the potential for criminal charges, the police are not going to arrest you without probable cause. The accusations of an 8 year old do not constitute probable cause. The worst that could happen is being questioned by police, but I doubt that it gets that far. You might want to contact the local police (closest to where your ex-brother-in law resides) and inform them that he is making false accusations.

Don't talk to the police without a lawyer. Even if you are innocent anything you say will be used against you in order to incriminate you and give credibility to her or his story. The police are not your friends and will not provide anything they find that gives you credibility to a jury. Get a lawyer and stay quiet the only one you can trust is your lawyer. Do not talk to family members(mom or dad) they will use them against you in court.

The questions you ask sound like you have some guilt over this. If you did nothing you should be OK. If you know the date and times he is saying this happened, maybe you were some where else and maybe have a wittiness or two.

Just relax and keep your cool.

It will be your word against these little kids.

If you do not have any criminal record or anything bad on it you will be OK.

If not - you may have some problems.

I would not worry about it since you are still a minor.

because this accuse sound so serious u could be locked up or your dad could be also locked up probabley he is just doing this to get back at your sister just keep far from him try to have nothing to do with him and try to avoid whatever he says believe me i have been there.
