Today I had my first car accident. I was backing up from a parking space, as was a person behind me. We crashed. My car was scratched, his was dented. He said that he saw me backing up and honked his horn. There was NO horn honk I heard. As I am 16, I think he may take advantage of that a put the crash as my fault, even when it was his as well. He acted all friendly and said, "well, at least no one got hurt, have a good day." After we had given all our information to each other. What happens if he blames this on me? What rights do I have?

He was backing up as well. It wasn't just me. He didn't see me either, and acted like he was lying.

well, we don't have all the facts, but if he was more out of his spot, then you are at fault. The issue of the horn honking doesn't really make a difference. The damages weren't mentioned (points of impact), so it's hard to give you a straight answer.

Don't worry about your rights. Report it to your insurance company so they can investigate on your behalf.

If? No question, he will since it's your fault. The law is quite clear, you can't back up without making sure you have a clear path. Period. Nothing in there about "Go ahead unless you hear a horn honking". Report it to your insurance company and when his insurance contacts yours they will settle and pay. From now on, be more careful backing up.

Unless the cops came and there was a file entered, the accident has no fault blamed on anyone. Depending on how your state handles insurance claims you will just have to pay a higher deductible or higher rates.

He can't really blame anything on you after the fact, and as long as you had insurance it will be covered.

It's his fault.
1. He said HE SAW YOU BACKING OUT. So he continued to back up knowing that you were doing the same.
2. He said he honked his horn. That is not the protocol. He needed to pull his car forward and back into the spot where it was parked.
You didn't know he was backing up untill you hit his car.
Don't let him mess with you.

Quit whining and let the insurance company handle this. The other guy was right about one thing -- no one was hurt. Your car got a boo-boo. Crap happens, man.

Contact your insurance agent. They will be able to inform you of the laws in your state.
