My husband and myself had a lone 3-4 years ago, not sure how much it was for,a charging order was put on my property for £ 32000, in my name only which we have now paid. My husband has now recieved notice of seizure of goods from the same bank for the same amount of money via a different collection agency, although we borrowed a lot it was not in excess of £60000, in fact it was more like £10000-£15000. Are they allowed to chase money from us individually even though the origanal loan was in joint names and we are still together

Contact the bank and advise them that somone somewhere has screwed up really badly and put you back on the collection list for the same debt. Then contact the collection agency and tell them that the loan has been paid already and that there has been a mistake and they should contact the bank.

The first step would be to call the bank and make sure all of the debt is payed, and then ask them if they sold the case to any collections agents, and request their contact information.
It sounds like happened is they sold the collection to this place, and then you went to the bank to pay back the money, but no one informed the collections people.
You might get lucky and just have to communicate with them that the debt has been paid in full and they will talk with the bank and leave you alone, although you might end up having to get a lawyer.
I hope this helps a little bit. I'm not english so I don't know their laws, but I do know how horrid collections can be. :) I hope everything works out!

Most of these loans are signed on the basis of "joint and several" responsibility. It means both of you are responsible for the entire amount of the loan and they can go after either one of you to collect it. Meaning, if you borrowed 300K together, they can go after your husband for the entire amount of the loan if they wish to. Or they can go after you for the whole thing if they want to. Get a lawyer though, if they start seizing property, you need one quick.

I think you should get advice from the citizens advice bureau and/or phone the collection agency, dont see how they can pursue this if its paid...I wish you well, good luck

i dont believe they are allowed to but for both your sakes i would consult a lawyer
