I am an Indian and since I do not know anything about criminal procedures, I would ask the reader for help. Suppose while riding a bicycle, a scooterist collides me from behind and I catch him. I want to take him to the nearest police station which is far away (or suppose even I do not know where the police station is). My bicycle is damaged and I have (fortunately) suffered a little only. Now how do I take that person to the police station? by catching hold of his hands? or are there other ways? or instead police will arrive if I make a call at the station after getting the number somehow? I need compensation for my bicycle. How to get that? What about eye-witneses people? I will have to request people to go with me to the police station? What if no one agree to go? and finally suppose the police officer is not willing to accept the case then what do I do and what happens to the scooterist? he will leave? sorry for asking so many questions.

First, get the plate number of his scooter, then his name and address. if he does not give his name and addres, at least ou have the plate number. Then you can call the police to assisst you. You file a complaint so the policeman has to listen to you. if the person is amenable, talk it out with him, if not, then you have the option to file charges against him in court. (but this would be expensive) . So get information from him in such a way that even if he walks away at the moment of accident, you will still be able to trace him and be able to file a complaint. If you have a cell phone with cam, take a picture of the man and his vehicle,

In a recent ruling, Supreme court has said that the police is bound to register an FIR, irrespective of the nature of the case, if the complainent has approached the police station. If you think that you are aggreived, and your rights given under the IPC or CRPC have been encroached, then you may simply walk the police station and tell your grievances to the constable present there. They WILL HAVE TO write your complaint.if you call the police on the spot, which you can by just dialing 100, they will register the case then and there. if it is about accident, you need not take the man to the station, just have his scooter registration number(vehicle number). As far as eyewitness are concerned, it is the duty of the officer on duty to make a case and investigate.You are just a complainent,and they will act on your complaint. They usually act.

The safest thing for you to do is get the individuals description and license plate #. Once you have that info yu bneed to call 911 and give them the information. The minute you grab the person is when a fight can ensue. Depending on the city or town many people will not be a witness for you but if you call the police right away you should be ok.

In Canada you can't grab hold of someone and take them to the police station (citizen's arrest) for a traffic accident. You could be charged for assault or unlawful confinement.
Call the police they will attend at the scene or if they won't get the names of all people involved and the licence plate number of the scooter (if it has one) and bring that to the station. If the police don't get involved you will have to go to civil court to get damages to your bike repaired (small claims court).

If he tried to run, you can hold him until the police arrive. I would not try to transport him, you may get in trouble for that. Call the police, and they will show up where you are. They will get all of his/her information, so you can try to recoup your lost costs.

If he is charged with a crime, the courts should make him pay restitution for your damaged property. If not, you will have to take him to small claims court.

Now, get off the internet, untie him, and call the police.

Don't hold anyone against their will, even if they wronged you. You must get their name, license plate, then report it.

If you got hurt, the police will have an obligation to investigate. You could work out an agreement with the person who hit you, also.. but never hold them against their will!
