he was 31 weeks at birth, he had resp. problems at birth that was still there when he was released from the hospital he was born on sep.18th he was released oct.4th he passed on the 6th!! now i just dont believe it was his mother! she doesnt sleepthat hard!! also they said first he was DOA now recently he had a pulse in the ambulance now my real problem is that i have not received anything but a death certificate that under the cause of death says (pending)! and in the box asking(were the autopsy reports availble before completion of cause of death) it says yes! i dont understand that! so basically i cant have closer because i dont know how my son died! what can i do to get my sons autopsy report and should i be seeking a lawyer! because i feel that my son was released from the hospital to early! but i dont want to point any finger and i dont have facts! another question does the funreal home know what happen to my son? please if anymore details are needed ask me! i really need help!

No, the funeral home does not know what happened to your son. If it says pending on the death certificate, that means that they are eventually going to release an actual cause of death, they may be awaiting toxicology reports. As to the question about the autopsy report being available at the completion of the death certificate, all that means is that they had the report available to look at before making the notation of "pending". You are going to have to wait until a cause of death is released before you contact a lawyer, since they need to know the cause of death for there to be any legal proceedings. First of all Im very sorry for your loss. The funeral home has no idea! If you were on the birth certificate you have every right to the autopsy unless there is an investigation pending. It could have been SIDS it could have been a rollover and it could have been the cause of respiratory problems. All of these will show a lot of the same things in the autopsy. You need to ask another hospital what their normal protocol is for a child with the same respiratory problems as yours had. If there is a big difference in the way it was handled its time to get a lawyer. Also if it was a rollover it was in no way the mothers fault as it can happen to anyone anytime. She may not have rolled on top of the baby the baby may have repositioned against her and she would have had no way to tell.

Definately first off - accept my sincere sympathy on your loss. I know it definately isn't easy for both of you.

Second, get a lawyer. If anything, they can review medical records, and autopsy reports for you. That is something you as a father in loss, should not have to do on your own.

Third - Although, it does happen and parents do fall asleep on their children - it is rare. You only hear about it because it's on the news because it happened. You don't hear about the families who do sleep with their children.. because thats NOT news.. I'm sure your SO is haivng issues from being accused of smothering her child. I remember having my son - even though I was asleep (and I'm normally a HARD sleeper), I knew of almost every breath, movement and sound he made (ask any mom, they probably will know exactly what I am talking about).

Seriously, get a lawyer. If not for closure immediately - to help you sort through everything.

Hi, Im so sorry for your loss. With babies they have to check out a lot of things. He had issiues before so then have to look at everything that was wrong with him. DOA could just mean he was DOA when they arrived at the hospital and died in the ambulance. Its pending because all the results are not in and they may have a different finding when the rusults are come back. I take it your not with your sons mother. If thats the case i would have someone look at all the papers you have. You are hi father and still have parental rights to know what happened.

You poor man! Let me first say that I am very sorry for your loss. I wish I could give you the answer you are looking for but I don't have that knowledge. I do think you need a lawyer because something is not right with the hospital ambulance contradictions and the death certificate and autopsy reports.

Just know that someone in the USA is praying for you.

I am sorry for your loss.

You maybe satisfied with the doctor's answers, and you may not be; anyway, I would definitely not let the hospital people know there maybe a law suit, it may jeopardize the evidence.

I know for a fact that in order to get an autopsy report, you only need to ask for it, this is legally binding, they HAVE TO give it to you. No question.

Ask the doctor who cared for your child while in the hospital, and the doctor who was responsible for discharging your baby.

Getting a lawyer may take some time, get now all the documents and information (names, events, times, circumstances, ...) you can and then get a lawyer.

Sit down and write step by step what happened with time and date. You may forget later specifics.

Chances are an investigation is still being conducted and that is why the cause of death is listed as "Pending". It is also very unlikely that the funeral home will be able to provided any additional information.

You should contact an attorney because it sounds as if you have a medical malpractice case plus he/she would be able to provide advice just in case it is deemed that your son's death is due to any type of negligence on either your or your wife's behalf.

Well it sounds like he died of respiratory problems. Get your sons medical records from the hospital and talk to a lawyer about the autopsy report. A lawyer can get that for you.

I am sorry about your loss, but the only thing i can tell you is: GET A LAWYER ASAP. That a mother rolls over the baby during sleeping is almost impossible. Has something to do with the motherly instinct. In my opinion the baby should have stayed in observation in the hospital. He came nine weeks to early. Usually preemies stay in care untill they reach the supposed birth date.
