for animals that get hit by a car is it right for that person not to be held responceable?or should they pay the cost of hitting that animal?the person who hit my dog was speeding in a kids area,there are signs up staeing that for drivers to drive slowly.

Sorry, but your dog had no business being in the road unless you were standing right there with him on a leash....period. As its owner, it is YOUR responsibility to keep him out of the roadways to keep him safe. Allowing dogs to run unleashed or unfenced is a violation of the law....and a safety hazard to humans, plain and simple. The owner of the pet is often held financially responsible for damage to the vehicle, too. It's not the driver's fault that you failed to keep your dog up as you are required (morally and legally) to do, and let it run out in front of his car because it wasn't properly supervised/restrained. :-/

It's often hard for drivers to see/avoid hitting an animal until it is too late. And when they DO see the pet and swerve to avoid hitting it, not only does that place THEIR life in danger....but those of other motorists in the area.

Unless the driver drove across your yard or into your living room in order to hit your dog, the fact is that your dog getting hit by a car was no one's fault but your own....so you're the one who should have to pay for it. Sorry if that sounds harsh, but it's the truth.

I'm sorry your dog is suffering pain that could have been soooooooo easily prevented. But my sympathies are with your dog, not with you.

The morally right thing to do is for the person who ran over your dog to pay the vet bills even if the dog is so badly injured that it dies.
Contact the police.
What if this person had hit a kid and not your dog? They would still have to pay medical bills and could go to prison or have their license taken off of them.
However it is your responsibility to make sure that your dog is not wandering the street and is kept inside or in a fenced area. You wouldn't let a small child wander the street, so why let your dog do the same? What if your dog had mauled someone?

Is it right for someone to be speeding? No. But this is entirely your fault. It is your responsibility to keep your dog safe from reckless people, like the one that hit your dog, and actually it is becoming more common that the people (and insurance cos.) who hit the dog are suing the pet owners for damage to their vehicles b/c the pet owner was being reckless by allowing the pet in the street. Learn from this...keep your dog out of the street.

first of all i am so sorry for the loss of your dog. i really hate to say this, but you can't count on other people to do the right thing. there will always be people who drive to fast and who don't care about running over a dog. that is why you have to make sure that your dog is protected. he should have been on a leash. i never let my dogs out of my gate without a leash on. there are to many things that could happen to them.

You are fortunate that the driver was speeding. Had he been obeying the law and hit your dog (assuming your dog was loose and in the road), he could sue YOU for damage to his car.

If the dog was on a leash, his fault, if not, your fault. That is basically how the judge will decide anything. As for the speeding, sorry but that is not going to affect anything.

that person should be held responsible what as you say the car hit a child should get that person to pay your vet bill if only we dog owners could prosocute these people

If your dog was not contained on your property and running loose or not on a leash and under your control you will not win this one.

well it goes both ways....ur dog shouldn't be out without a leash and collar on, but on the other hand, he shouldn't have been speeding.

Are you squeaky-clean legal? I mean, was your dog supposed to be on leash? If you're "clean," go ahead and call the sheriff. (I wasn't. So I didn't.)
