I got into a car accident a few weeks ago, I was hit by a drunk driver and another oncoming vehicle, none was my fault and my car was put on the road the day before the accident which means I am still waiting for the title. I have a rental now and they are telling me I have to give it back tomorrow. I will not get any of my settlement for another 2-3 weeks, because the DMV has to send my title. I am having them rush it but they still say 2 weeks. It has been 15 days since my accident and I have a job and 2 children who I have to transport back and forth to school, and if they take the rental away I am left with nothing. The other drivers insurance is paying for it, so shouldn't he have to pay until I get my settlement? I don't understand why they are not going to let me keep it until I get some money to buy a new car. If I lose the rental I also may lose my job because I will have no money to get back and forth and my kids won't be able to get to school... please help :-)

Start with your insurance adjuster. (Your insurance company for starters.)

Explain your problem. They may have you get a different rental.

You might want to check with "Rent-a-dent" type rentals which are low-cost and usually safe. The main thing is to get one that the insurance company will pay for.

This problem should be resolvable. It's not all that uncommon.

One word comes to mind---LAWYER! Get yourself an attorney immediately! You were hit by a drunk driver!!! If the insurance company stops paying for the rental--you have damages! Insurance companies want to "minimize" not "maximize" losses!

In NYS you have to "add" rental coverage to your policy. There are several policy plans available to which the insurance companies will only pay the policy limits! I have $40 a day for 45 days. That is all the insurance company would pay regardless of fault!

I think your best bet is an attorney who may be able to persuade the other carrier to "pay up" now instead of later!

they are supposed to pay for a rental until you receive your settlement, if they cant pay until they receive title then they have
let you keep the car, ask your agent to help you explain to the other company
