needed a place to keep it.They offered to let us keep it there and her grandpa had no problems with the arrangement.It turned out that the girl had been saying bad stuff about us and our child.I told her that I didn't want anything else to do with her, but she went on to send me nasty and threatening text messages.I told my boyfriend to ignore her, but he is hot headed and called her up.She told him to never show up on her property or she would shoot him in the head. So we got his brother to go out there to get the boat, but it was gone.When we called them up she said that we must have tresspassed on her land and got it already.So since she decided to lie and be difficult we went to the police.They told us it was a civil matter and they couldn't search the property unless we had proof it was there somewhere.How do we get proof without trespassing?We tried to talk to her Grandpa, that didn't work.Its just not fair that they will probably get away with this.What do we do, what CAN we do

I almost don't want to respond to this because you may not like the answer but have been in many similar circumstances myself. First off I imagine that you do have a title, registartion and reciepts for any purchases regarding this matter? Secondly you have to ask, what would you do in this situation, if you were trying to steal someones Bass boat. First off I would not keep it at my house were a cop could show up and find it easily. You need to figure out who their true friends are and check out their properties. If you find it; do not confront that person, keep on driving and call the cops immediatly. If that doesn't work you have to figure they may have already scratched off the serial number and tried to sell it filing for a lost title or something along the lines of that. Depending how expensive it was and how much time you have to spend on this you might want to hire a private investigator they often times; if you find the right one, will have better luck than the police will in many matters. Also you need to save all threatining e-mails and letters because freedoom of speach if one thing but a direct threat is not. If all else fails you need to catch them on video breaking a law serious enough for bad consiquences and maybe a little black mail is in line. Or just plant a bunch of drugs on them carefully and calll the cops. The law is blind and really doesn't help that many people out, keep that in mind. There is a reason why they did this it is because they figured they could get away with it. If you do hire a private eye keep all bills and records for any time and money lost because if they do find it you can go after the thieves for this money. All I can say is hopefully your boat is in the same state still because if these people were smart they would have left behind no evidence and with no evidence you have nothing to stand on just like the cop said. Good luck and if you get creative with these people and do something on your own be very carefull because remember the law is blind.

You go onto the property of people next door, on the property behind the property ( you tresspass on thier property to look onto the other property)
And you basicly told the police too much also, you merely should have told them that the boat was stroed at ..... address and it is missing, and file a report for a stolen boat.
But at this point you sue them for the value of the boat.

Yes you will have to sue them in Civil Court for the property. You allowed them to keep the boat there.

do you have the registration and license number,also most states require that boat trailers are inspcted for safty reasons,take this info to the distric attorny and the fish and game people,also the state police.
if it moves on land or on water two of the three willget it,if it sold then you have another legal way to break it off in them and file charges of theft and more.

BUMMER. that will teach you to leave property on someone elses property again. it does sound like a civil matter. have you contacted the prosecutors office yet? maybe they can direct you. looks to me like your going to have to hire an attorney. you could at least pay one to write a letter to them. maybe when they see that your serious they will come around and give your boat back.

If you have any documentation showing ownership of the boat, report it as stolen...Last known location at your ex friends house...The police should then investigate its whereabouts...
