Yes, it is considered sexual battery if there was intercourse., I not then it would be sexual assault. The moment you said no, the law was broken.
Now to be honest with you, you should have not put yourself in that situation. By this I don't mean that its your fault, just that this is very unfortunate and horrible.

That is considered rape in my book. NO it is not your fault. He knew you were drunk and he took advantage of you. If I was drunk and I knew a guy really good I probably would get un the car with him, but if he crossed that line I would let him know that he has passed it. I would do just like you i would say stop and then i would hit him in his face.

It's rape. You put yourself in a very bad situation with a bad man who took advantage of you. A decent guy wouldn't have done that. Report him while the scratches are still fresh on his neck. Just because you are drunk does not give men the right to force themselves on you.

Well, when u are drunk, u dont know what is going on. U should have used ur instincts and u should have never went with this guy. I think it is rape unless u didnt report it and then he might have gotten what he wanted. Never go with anyone when u are drunk especially a guy that u dontknow what he is capable of

Its good to accept full responsibilty for your actions. You could have evaded the situation completely had you done a few things differently, but as far as him raping you, thats not completely your fault. Its both of your faults I would say. Try using a ballsqueeze technique next time, something like that may decrease his sex drive very quickly next time.

This is a no brainer. No offense on you though. You said no, which under any circumstances means NO. He definitely took advantage of the situation with you being drunk. You weren't at fault either. He had many signs telling him to stop and he didn't.
